SPENCE James A. SPENCE & others to Henry E. SPENCE-Deed Bk. 3, p. 476-477 5 Feb 1872 This Indenture made this the 5th day of February A.D 1872. Between Jas. A. SPENCE and wife Winnaford, Jas. M. HARDY and wife E. Susan, Pinkney H. SPENCE, Nancy Winniford SPENCE of the County of Lenoir, Jas. D. GARDNER and wife Elcy, Timothy SPENCE and wife Ursula of the County of Wayne and W. D. SPENCE and wife Mary of the County of Greene of the first part and Henry E. SPENCE of the County of Lenoir of the second part; all of the state of North Carolina. Witness the that the said parties of the first part, for and in consideration of the sum of Five hundred dollars to them paid by the said party of the Second part the receipt of which is hereby acknowledged have bargained, sold and conveyed unto the said party of the second part, his heirs and assigns forever their undivided interest, rights and titles in a tract of land lying and being in said County and State known as the Joseph HINES place, more recently the property of James M. SPENCE, dec’d, adjoining the lands of W. S. BYRD, Edward DEAVER and others and bounded as follows, Beginning at a short straw pine in the head of Panther Creek in Barbara HINES and Richard ROUSES’S corner, thence with said ROUDES’S line S 73 E 26 poles to a stake Ed DEAVERS corner then with DEAVER’S line N 14 East 132 poles to a stake in Richard ROUSES line, then with his line West 30 poles to a Stake another of said ROUSE’S corner then due North 9 poles to a stake in said ROUSES line then West 116 poles to a stake, then South 126 poles to the beginning containing one hundred, high and a quarter acres more or less, To him the said party of the second part, his heirs and assigns together with all and singular the right privileges and improvements thereunto belonging or in any way appertaining, And the said parties of the first part for themselves their heirs and assigns do covenant with the said party of the second part, that they will forever warrant and defend the right and title of the said conveyed lands against the lawful demands of any and all persons whatsoever. YALVERTON, Judge of Probate for said County personally appeared Nancy W. SPENCE, Pinckney H. SPENCE, James A. SPENCE & wife Winnie SPENCE & J. M. HARDY & wife Bettie S. HARDY and J. D. GARDNER & wife Elsie J. GARDNER & Timothy SPENCE & wife Ursula SPENCE persons described in and who signed the annexed conveyance and severally acknowledged the due execution thereof for the purpose therein expressed, And therein from the said Winnie SPENCE, Bettie S. HARDY, E. J. GARDNER & Ursula SPENCE being by me personally examined apart from their said husbands touching their voluntarily consent thereto acknowledged that they executed the same freely and without fear or compulsion of their said husbands and do now voluntarily assent thereto, and hereby noting wish their right of dower in said lands. W. T. YELVERTON Probate Judge State of North Carolina Greene County I Geo. W. LANE, Justice of Peace do hereby certify that W. D. SPENCE and Mary C. SPENCE his wife, personally appeared before me this day and acknowledged the due execution of the annexed deed of sale and the said Mary C. SPENCE being by me privately examined separate and apart from the said husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily without fear or compulsion of her said husband, or any other person and that she doth still voluntarily ascent thereto.
