Mason http://www.genrecords.net/emailregistry/vols/00016.html#0003873 September 19, 2018, 3:35 pm Written: 1895 Transcribed by Sloan Mason Lenoir County Register of Deeds 30 Nov 1895 Lease of Emanuel JARMAN to Timothy SPENCE Bk.18 p.784-785 North Carolina Lenoir County This agreement made and entered into by and between Emanual JARMAN party of the first part and Timothy SPENCE all of the County of Lenoir and state of North Carolina, Witnesseth, that Emanuel JARMAN agrees to let, rent and lease and by these presents doth let rent and unto Timothy SPENCE part of the second part for the term of one year commencing on the first day of January 1896 the following named and bounded premises of allowing that is to say-Beginning on the Rockford Road and running with an old road to a ditch bridge and then with the said ditch as it runs to DAMSONS line, then with DAMSONS line to the Neuse River then up the Neuse River to O. N? UZZELL's line, then with the said O. R? UZZELL'S line to the beginning containing about a two house farm, But the said Emanuel JARMAN doth except and reserve a small house a lot at the high banks of the river for his own use, the said lot containing by estimation one and one half acres. Also the said Emanuel JARMAN agrees to let rent and leave unto the said Timothy SPENCE for the term of one year commencing on the first day of January 1896 the dwelling house now occupied by the said Emanuel JARMAN, and the lot on which the said dwelling stands on the West side of the public road containing four acres for which the said Timothy SPENCE doth agree to pay with the said Emanuel JARMAN his heirs or legal representatives as rent for the above described promises, Twenty five hundred pounds of good merchantable lint cotton, or the value of Twenty five hundred pounds of good merchantable lint cotton in the event that not that much cotton is made on the said land by the said Cotton shall be determined by the market rate of cotton on the 15th day of Oct 1896. It is further agreed that the above rent shall be due and payable on the 15th day of October 1896 and upon the demand of the said JARMAN or his legal representatives, the said SPENCE shall deliver or cause to be delivered the said Twenty five hundred pounds of lint cotton at the Gin House of Daniel HINES in five bales in good merchantable order. It is further agreed that the said Timothy SPENCE shall split and put upon the fences around said premises rails amounting to the number of Five hundred (500, to repair said fences at his own cost, to pay for cleaning out all ditches on said premises except the leading ditch as to that he is to clear that except one third of cost of cleaning which is agreed to be born by the said JARMAN. It is further agreed that said Timothy SPENCE shall dwell? and truly? preserve said premises during his lease and shall not give away sell nor dispose of any wood, lumber crops or --- or product of any leased? without the permission of the said JARMAN and until the rents are paid in full, and it is further agreed if the said JARMAN shall furnish the wire fencing on the said premises the said SPENCE agrees to put it up at his own proper cash or pay for the same if not put up in a reasonable time. In Witness whereof we the said Emanuel JARMAN and Timothy SPENCE in conformity to the above agreement has hereunto set our hand and seals this Nov. 30, 1895. In the presence of: Geo. L. TAYLOR H. E.
