SPENCE Bk. ?, p. 209 17 Feb. 1894 State of North Carolina Lenoir County (crossed out) Wayne County inserted This Deed made this 17 day of Feby. 1894 by Henry E. SPENCE of Wayne county and State of North Carolina of the first part to The Heirs and joint heirs of James M. SPENCE, Sr. Dec’d. of Lenoir County and State of North Carolina, of the second part. Witnesseth That said Henry E. SPENCE in consideration of said heirs, the receipt of which is hereby acknowledged, has bargained and sold and by these presents does bargain, sell and convey to said heirs of James H.? SPENCE, Sr. Dec’d & his heirs and assigns, a certain tract or parcel of land in Lenoir County, State of North Carolina adjoining the lands of H. E. SPENCE and others, bounded as follows, viz: one half acre of land where the old Burial Ground is now situated to be for the use of the SPENCE family and all connected thereto by marriage, the said 1/2 acre being situated on the lands I now own in Lenoir County, NC by Henry E. SPENCE. To have and to hold the aforesaid tract or parcel of land and all privileges and appurtenances thereto belonging to the said Heirs of James M. SPENCE, Sr., Dec’d, their heirs and assigns, to their old use and behoof forever. And the said H. E. SPENCE covenant that he is seized of said premises in fee, and hath a right to convey the same in fee simple, that same are free from all encumbrances, and that he will warrant and defend the said title to the same against the claims of all persons whomsoever. In testimony whereof, the said H.E. SPENCE & wife Maggie SPENCE have hereunto set their hands and seals the day and year first above written. Henry E. SPENCE (seal) Maggie SPENCE (seal) Attest: W. B. WHITFIELD North Carolina, Wayne County W. B. WHITFIELD, do hereby certify that Henry E. SPENCE and Maggie SPENCE his wife, personally appeared before me this day and acknowledged the due execution of the annexed Deed of Conveyance; and the said Maggie SPENCE being by me privately examined, separate and apart from her said husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily, without fear or compulsion of her said husband or any other person, and that she doth still voluntarily assent therein.
