STANLEY, guardian of children of C. H. CLARK, & Charles CLARK, from Wm. CLARK to Elizabeth CLARK, known as the Reuben CLARK lands, to J. L. NELSON. This Indenture made this 16th day of December 1872 between William F. STANLY guardian of William A., Hepsy C., Anna F., Leona P., Rubin W. and Henry C. CLARK, children of C. H. CLARK and Oscar CLARK, child of Charles CLARK of the County of Lenoir and State of North Carolina of the first part and J. L. NELSON of the County and State aforesaid of the second part. Whereas, Elizabeth CLARK, late of the county of Lenoir, NC is was seized in her lifetime, in her demesne as of fee, of a certain tract of land, lying and being, in the county of Lenoir, State of North Carolina, known as a part of the Ruben CLARK lands, and bounded as follows viz: beginning at a stake on the side of Neuse River bank and runs No. 53 W. 307 poles to a stake in the field west of the road then No. 51 1/4 E 53 W 307 poles to a stake in the field west of the road then No. 51 1/4 E 53 poles to a stake int he Branton’s patent line then So. 69 1/3 E 37 poles to Branton’s corner then with his other line No. 20 E 60 poles then So. 32 3/4 plus along a ditch the So. 30 E. 84 poles then South 20 E 16 poles then due S 18 poles to a mouth of a small branch at the Slue then with the edge of the Slue to a large whit oak at the River then up the River to the beginning containing One Hundred and Nine acres more or less. It being a tract of land conveyed by William CLARK to the said Elizabeth CLARK by deed dated 13 day of December 1850 and enrolled in Book 32, page 190 in the Registers Office of Lenoir County, NC. And whereas the said Elizabeth CLARK in her lifetime, being so seized of the aforesaid tract of land did by her Last Will and Testament in writing devise 54 1/2 acres of the said tract of land to C. H. CLARK for life, and after his death to his children, in fee, viz: William A., Hepsy C. , Anna F., Lenora P., Rubin H.?, and Henry C. CLARK, and the balance of said tract of land she devised to Charles CLARK for life, and after his death to his children, (Oscar CLARK being his only child) in fee. And whereas the said William F. STANLEY being duly appointed, by the Judge of Probate of Lenoir County, NC guardian to the aforesaid children of C. H. CLARK and Charles CLARK. did on the 4th day of November 1872 file a petition in the Superior Court of Lenoir County, NC-as guardian aforesaid, for the purpose of selling the interests of his said wards, int eh aforementioned and bounded tract of land, they having an interest, in fee, and in common, after the death of their respective fathers-devised to them by said Last Will and Testament of the said Elizabeth CLARK, for causes in the petition therein stated; and the said Court on the 4th day of November 1872, ordered and decreed, that the premises aforesaid should be sold at public auction after thirty days advertisement at the Court House door, and three other public places of Lenoir Co., NC between the hours of 10 O’clock A.M and 3 O’clock P. M na report within ten days. The said order and decree was, on the 3rd day of December 1872, approved by W. J. CLARK, Judge of the 3rd Judicial District of NC. In pursuance of which said order and decree, the said William F. STANLEY, guardian as aforesaid, to whom the execution of the decree was entrusted, by said Court after having given due public notice of the time and place of sale, did on the 6th day of December 1872, expose the premises aforesaid to sale by public auction, and sold the same to J. L. NELSON for the sum of Nine Hundred Dollars lawful money of the United States, he being the highest bidder and that the best price bidder for the same; which all on the report thereof being made to the Clerk of Superior Court, was on the - day of December 1872, confirmed and not he day of —- 1872 approved by W. J. CLARK, Judge as aforesaid. And it was adjudged and considered but he Superior Court of Lenoir County, that the same should be, and remain firm, and stable as by the records and proceedings of said Court, relation being thereunto had will at large appear. Now this indenture witnesseth, that the said William F. STANLEY, guardian as aforesaid, for and inconsideration of the sum of Nine Hundred Dollars to him in hand paid but he said J. L. NELSON, at and before the sealing and delivery hereof, the receipt where of is hereby fully acknowledged, has given, granted, bargained, sold, aliened and confirmed, and by these presents does give, grant, bargain, sell, alien, and confirm, unto the said J. L. NELSON all and singular the right, title, and interest, and estate of the said William. William A., Hepsy C., Anna F., Lona P., Rubin W., Henry C. and Oscar CLARK, children of the said C. H. CLARK and Charles CLARK, int he land and premises herein before described, and bounded, being the lands which was conveyed by William CLARK to Elizabeth CLARK as aforesaid, as fully and completely, as he can do by virtue of this office of guardianship, and the said decrees, and orders of said Court, and no further. To Have and too Hold, the move described and bounded land aforementioned, to him the said J. L. NELSON, his heirs, and assigns forever so far as the right, title, interest and estate of the said children of C. H. CLARK, and Charles CLARK are concerned and no further. STANLEY, Guardian Lenoir County: In the Probate Court The execution of the within and foregoing Deed from William F. STANLEY guardian to J. F. NELSON, was the 17th day of December, 1872, acknowledged before the undersigned, Probate Judge of said County by the said William F. STANLEY.
