This Indenture made this the 10th day of January A.D. 1870 by and between John TULL of Lenoir County and State of North Carolina of the first part and Eli COBB, Caroline COBB, Alfred COBB & Henry CURTIS of the same County and State parties of the second part; witnesseth that the said John TULL for and In consideration of the sum of one dollar to him in hand paid the receipt whereof is hereby acknowledged together with the further consideration of the covenants hereinafter contained has demised, granted and to farm Let and he does hereby demise and to farm Let unto the said Eli COBB, Caroline COBB, Alfred COBB & Henry CURTIS a certain piece or parcel of land lying and being in Lenoir County and State of North Carolina on the north side of Neuse River being on the south western part of the plantation where the said John TULL now lives, and adjoins the lands of J.H. DIBBLE, bounded as follows, beginning in said DIBBLES line where a new ditch cut by said DIBBLE crosses said line and runs with said new ditch, cut by said J.H. DIBBLE through the lands of said John TULL tot he sand ditch, thence with the sand ditch as far as the river low grounds will admit to clear, thence up the river low grounds to said DIBBLE'S line, thence with his line to the beginning. Containing thirty acres or thereabout, to have and to hold the same to them the said Eli COBB, C. COBB, A. COBB & H. CURTIS their executors and administrators until the 31st day of December 1872. The said Eli COBB, Caroline COBB, Alfred COBB & Henry CURTIS for themselves their executors, administrators and assigns covenant and agree to and with the said John TULL, his heirs and assigns that they the said Eli COBB, Caroline COBB, Alfred COBB & Henry CURTIS will clear, fence and ditch said land, and put all of it in good farming order. The fences to be five feet high and kept in good order, and the ditches to be kept well cleaned out and any new ditch to be cut which the said John TULL may think necessary for draining said land. The said Eli COBB, Caroline COBB, Alfred COBB & Henry CURTIS covenant and agree to and with the said John TULL that they will turn said land over to said John TULL his heirs or assigns on the 31st day of December 1872 in good farming conditions under fence five feet high, made of sound good rails, and ditches, well cleaned out. The said Eli COBB, Caroline COBB, Alfred COBB & Henry CURTIS covenant & agree to & with the said John TULL his heirs & assigns that they will work said land in a formerlike maner and will clear one third of the land by January 1st 1871, one half of the balance by January 1st 1872, the balance by Dec. 31st 1872. It is hereby expressly understood & agreed that if any of the foregoing covenants or agreements are not complete with them & in that case the lease and contract to be void. It is further agreed that if the said Eli COBB, Caroline COBB, Alfred COBB & Henry CURTIS or either of them shall become annoying to the neighbors by any unlawful act or acts of what kind soever, then and in that case this lease and contract shall be voided at the option of the said John TULL.
