Transcribed by Sloan Mason ROBERT W. BEST and CLARISA BEST his wife to J. T. WINFIELD-1862 This Indenture made this 23rd day June A.D. 1862 Between Robin W. BEST and Claricy, his wife of Lenoir County, N.C. of the 1st part and J. T. WINFIELD of the same state and county of the 2nd part. Witnesseth that the sd. Party of the first part for and in consideration of the sum of six hundred and seventy nine dollars to them in hand paid the receipt of which is hereby admitted, hath bargained sold and conveyed unto the sd. Party of the 2nd part his heirs and assigns, a certain house and lot in Lenoir Institute in sd. County & state bounded on the south by S. B. DOZIER? West by A.? WILSON'S line north by Luther BABBIT East by Josiah BELL containing 2 acres sd. House and lot with the appurtenances thereto belonging to him the sd. Party of the second part his heirs and assigns forever, and the sd. party of the 1st part doth hereby warrant and defend the rights and title of sd. lot and appurtenances for themselves their heirs and assigns unto the sd. party of the 2nd part his heirs and assigns forever against the claims of all other persons. In testimony whereof the sd party of the 1st part doth hereunto set their hands and seals-date as above. WINFIELD hath produced a Deed of Conveyance made to him from R. W. BEST, Clarisa BEST of a certain Tract or Parcel of Land, lying and being in the county of Lenoir in the State of N.C., and procured the same to be proved by W. H. CUNNINGGIM, Jr. in the Court of Pleas and Quarter Sessions, of our county of Lenoir and it being represented to our said Court, that Clarisa BEST wife of the said R. W. BEST is so infirm that she cannot travel to the said Court of our said county of Lenoir to be privily examined as to her free consent in executing the said conveyance; therefore we command you, or any two of you, that at such certain day and place as you shall think fit, you go to the said Clarisa BEST if she cannot conveniently come to you, and privily and apart from her husband, examine her, the said Clarisa BEST whether she executed the said conveyance freely and of her own accord, without fear or compulsion of the said R. W. BEST her husband; and the examination being distinctly and plainly wrote on the said Deed, or on some paper annexed thereto, and when youshall have so taken the said examination, you are to send the same closed up, under the seals of you or any two of you, together with this Writ, unto our said Court, to be held for the said county of Lenoir the third Monday of March next ensuing, in the year of our Lord 1868. Nick HUNTER State of North Carolina Lenoir County Court January Term 1868 On motion to court upon the part of J. T. WINFIELD who represents that Mrs. Clarisa BEST, a feme covert is so infirm that she cannot come to Court without great inconvenience to her health & further appearing that she has joined in a deed of conveyance with Robert BEST to said J. T. WINFIELD and the signatures and acknowledgment of Robert W. BEST, and wife Clarisa BEST to said deed having been proved by the Oath of W. H. CUNNINGGIM, one of the subscribing witnesses thereto it is ordered that a commission issue to F. A. BROTHERS and William ARTHUR according to Act of Assembly to take the private examination of the said Clarisa BEST and report to Court. Nick HUNTER, C.C.C. State of North Carolina Lenoir County Pursuant to the annexed Commission we this day proceeding to take the private examination of Clarisa BEST wife of Robert BEST trusting? Her voluntary assent to the foregoing deed of Conveyance separate and apart from her said husband whereupon she the said Clarisa BEST declares that she voluntarily assents to the said Conveyance and that she executed the same freely and her own accord without fear or compulsion of the said Robert BEST her husband. A. BROTHERS and William ARTHUR, to whom a commission was issued to take the private examination of Clarisa BEST, wife of Robert W. BEST, touching her free consent in the execution of a certain deed fro the said Robert W. BEST, and Clarisa BEST to J. T. WINFIELD having returned their report during the present term showing that they examined her privately, separate and apart from her husband, and that she acknowledged, when so examined, that she executed the said deeds volunteerily and of her own free will and accord and without any force, fear or undue influence of her said husband or any other person. It is therefore ordered that the said deed report and commission together with all the proceedings of this court, concerning the same be registered. Nick HUNTER , C.C.C. Received of W. B.
