Transcribed by Sloan Mason F. A. BROTHERS & WIFE TO J. W. BROTHERS-1874 This Indenture made the seventeenth day of December in the year One Thousand Eight Hundred and Seventy Four between F. A. BROTHERS & wife Charlotte BROTHERS of the county of Wayne and State of North Carolina of the first part and Jos. W. BROTHERS of the county of Lenoir and State of North Carolina of the Second part witnesseth: That the said party of the first part for and in consideration of the sum of Five Hundred Dollars, the receipt of which is hereby acknowledged have given granted, bargained and sold and do hereby give, grant, bargain, sell and convey to the said party of the second part, his heirs and assigns, all that tract or parcel of land lying in the county of Lenoir, State of North Carolina at Lenoir Institute, bounded as follows: Beginning at the Southwest corner of the Church Lot and running with the public road south 80 yards to a Post oak Stump, thence East with Mrs. BALANCE'S & W. D. FERREBEE'S line to 2nd Street, thence north 19 west, 24 poles to the road at Mrs. PRIDGEN'S line thence with said line to the north east corner of the Church Lot thence with said lot to the south east corner of the same thence west with said lot to the beginning containing six acres, more or less. To have and to hold the same with the appurtenances thereunto belonging to Jos. W. BROTHERS, the said party of the second part, his heirs and assigns forever. And the said party of the first part, for the consideration aforesaid, do hereby covenant and agree to warrant and defend the premises aforesaid to the said party of the second part, his executors, administrators and assigns, against the claim and entry of all persons whatsoever, and they do further covenant that they,t he said F. A. BROTHERS and wife Charlotte BROTHERS are seized of the premises in fee simple, and have power to make and convey such an estate by this Indenture and have done the same by these presents. BROTHERS Wayne County In the Probate Court Be it Remembered, That on the 17th day of December A.D. 1874, before the undersigned Judge of Probate for said County, personally came F. A. BROTHERS and his wife C. T. BROTHERS, the persons described in and who signed the foregoing deed and acknowledged the due execution thereof by them as their act and deed. And thereupon the said C. T. BROTHERS being by the undersigned privately examined, separate and apart from her said husband, touching her free consent in the execution thereof, does declare, on such her examination, that she executed the same voluntarily and without fear or compulsion of her said husband, or of any other person, and does still voluntarily assent thereto. YELVERTON, Probate Judge Lenoir County In the Probate Court It having been duly certified to the undersigned, Probate Judge of said County of Lenoir, by the Probate Judge of Wayne County under his official seal, that the execution of the foregoing deed has been duly acknowledged before him by F. A. BROTHERS and C. Y./T.? BROTHERS his wife, the parties who signed the same, and it appearing from said certificate that the private examination of the said C. Y.? BROTHERS is in due form: It is therefore, ordered that the said deed and certificate of probate together with this order, be registered.
