CLARK & wife Mary of Lenoir Co., & John L. NELSON of Pitt Co., NC This Indenture made on the twenty seventh day of December One Thousand Eight Hundred and Seventy one, between Council H. CLARK and his wife Mary of the County of Lenoir and State of North Carolina on the one part and John L. NELSON of Pitt county and State aforesaid of the other part, Witnesseth: That the said C. H. CLARK and wife Mary for and in consideration of the sum of Eight Hundred Dollars to them in hand, paid by the said John L. NELSON at the time of executing these presents, the receipt whereof is herby acknowledged, hath granted, bargained, sold conveyed, aliened and confirmed and by these presents doth grant bargain, sell convey, alien, and confirm unto the said John L. NELSON his heirs and assigns, a certain tract or parcel of land in the County of Lenoir and State aforesaid situated on the water Neuse River and adjoining the lands of Frederick JONES and others, beginning on the avenue coming with Mrs. LEE and JONES and running South 52 1/2 East 232 poles and six links to Staneton Creek at the indigo hole, and thence down said Creek to Neuse River, then go back to the beginning corner, thence running North 51 1/4 East 45 poles near a sassafras, thence South 53 East 307 poles to Neuse River, thence up said River to the mouth of Stonington Creek containing One Hundred and thirteen acres, more or less. To Have and to Hold the said land and premises, and all and singular the tenements, hereditaments, woods, ways, waters, mines, minerals, rents, issues, profits, remainders, reverses, privileges, and appurtenance thereunto belonging or in any other wise appertaining to him the said John L. NELSON, his heirs and assigns to his and their only proper use and behoof in fee simple forever. And the said C.H. CLARK and wife Mary and their heirs all and singular the premises hereby conveyed to the said John L. NELSON his heirs and assigns shall and will warrant and defend from the claim or lawful claim of any and all forever. In testimony whereof the said C. H. CLARK and wife Mary doth hereunto set their hands and seals the day and year first above written. C. H. CLARK, (SEAL) Mary CLARK (SEAL) Signed, sealed and delivered in the presence of James L. CANADY, & Susan E. WILSON Lenoir County: in the Probate Court The Execution of the within and foregoing deed from C. H. CLARK and Mary CLARK, his wife, to John L. NELSON, was this 11th day of February 1872, exhibited before the undersigned Judge of Probate for said County and execution thereof by the said C. H. CLARK and Mary CLARK is proved by the Oath and examination of James L. CANADY, one of the subscribing witnesses thereto. And thereupon the said Mary CLARK, being by the undersigned privately examined separate and apart from her husband, the said C. H. CLARK, doth declare on such her examination, that she had executed the same freely of her own will and accord, and without any force or fear or undue influence of her said husband or any other person and did still voluntarily assent thereto. I therefor let said deed with this certificate be registered. Witness, my hand and official seal. Wm. W. N.
