I Windal DAVIS, Sr. of the county of Lenoir and State of North Carolina, being of perfect health and sound memory knowing it being appointed for all men once to die; I therefore make, and ordain this to be my last will and testament, my body to be buried in a Christian like manner at the discretion of my Executors, then the rest of my property as follows: viz: Item-I give and bequeath unto my son Samuel DAVIS, one dollar, with one hundred and fifty acres of land, lying in Duplin County, with the lands and negroes that I have given him before. Item- I give and bequeath unto my daughter Mary KINCEY, one dollar with the negroes & the property I have given her before, and one negro woman named PATIENCE. Item-I give and bequeath unto my daughter Elizabeth WOOTEN, one dollar with the negroes & other property. I have given her before, and one negro man named SAM. Item-I give and bequeath unto my daughter Sally JERMAN, one dollar, with the negroes & other property, I have given her before and one name named JACK, and one woman named PHEBE. Item- I give and bequeath unto my son James DAVIS, one dollar with the lands and negroes that I have given him before. Item- I give and bequeath unto my son John DAVIS one dollar with the lands and negroes that I have given him before. Item-I give and bequeath unto my son Windal DAVIS, one dollar, with the lands and negroes that I have given him before, and one case of large? bottles, and one still. Item- I give and bequeath unto my grand daughter Mary LAWSON, one negro man named CHARLES, with the other property-I have given her before. Item- I give and bequeath unto William SLADE that married my daughter Nancy one dollar/ Item- I give and bequeath unto my grand son James M. DAVIS, one negro boy named BILL. Item- I give and bequeath unto my grand son James W. DAVIS one negro boy named JESS. Item- I give and bequeath unto my grand son John S. DAVIS, one negro boy named PETER. Item- I leave two negroes to be sold in the family, and he that will give the most-is to have them-and the money to be divided between my seven children, the names of the two negroes are CHANEY and ISAAC-and the rest of my property of all kinds to be sold-and divided also-and one negro man named HENRY to be sold as the other two negroes is and divided also. Item- I then lastly, for my Executors do appoint my sons John DAVIS and Windal DAVIS and empower them with as much power as I am entitled to nothing to debar? this from being my last will and testament revoking all others whatsoever-In Witness I have hereunto set my hand and fix my seal this the 6th of December 1833. HUNTER, Clerk of the Court of Pleas and Quarter sessions, in and for the County and State aforesaid, do hereby certify the foregoing to be a true copy of the Last Will and Testament of Windall DAVIS, SR., deceased, as found on file in this office.
