Phillips Lenoir County, NC Last Will and Testament dated Dec 10, 1870 files July 4, 1871 I Drewry H. Phillips, of the county of Lenoir and the state of North Carolina being of sound mind and memory, but considering the uncertainty of my earthly existence, do make and declare this my last will and testament in manor and form following, that is to say First - My executor herinafter named shall provide for my body a decent burial, suitable to the wishes of relations and friends. Pay all funeral expenses, together with my just debts howsoever and to whomsoever owing out of the money that may first come into his hands as a part or parcel of my estate Item-To by beloved wife, Martha J. Phillips, all of my lands and personal property including everything I now after paying all of my just debts during her natural life or widowhood and at the expiration of either her natural life or widowhood it is my will and desire that all of my lands and personal property be equally divided between all my children or their lawful representatives to be theirs in fee simple forever. and lastly I do hereby constitute and appoint my trusty friend Needham Moore my lawful executor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof, hereby revoking and declaring utterly void all other wills and testaments by me heretofore made. In witness I the said Drewry H. Phillips do hereunto set my hand and seal this 10th of Dec AD 1870 Seal Signed, sealed published and declared by the said Drewry H. Barwick Lenoir County - In the Probate Court Needham Moore to The Probate Court Application for the Probate of the last will and testament of Drewry H. Phillips. The application of Needham Moore shows that 1. Drewry H. Phillips late of Lenoir County died on the 24th day of Dec 1870, leaving a last will and testament, whereby he appointed Needham Moore Executor thereof. 2. That the estate of the said Drewry H. Phillips consists of about 400 acres of land situated in said county and is worth about $3000 and personal property consisting of household and kitchen furniture, corn, cotton, stock, worth about $1500. 3. That all of the said property both real and personal was willed to the widow of the said testator during her lifetime or widowhood after paying all of his just debts and burial expenses. 4. That the names and residences of the parties entitled to the testators property at the death or marriage of his widow are as follows: William Phillips, Thos. Phillips, Susan Phillips, Needham Phillips, Albert Phillips, James L. Phillips all of Lenoir County, NC. All of whom are minors and without guardian.
