Dec. 18th 1900  I Nancy Foss being of sound mind, doth make this my last will and testament. Revoking all others heretofore made by me. In the following form, to-wit:  Item 1. It is my desire that all my burial expenses and other debts be first paid out of any money into the hands of my executor.  Item 2. I give unto my sons J.W. and Simon Foss and to their heirs ­ assigns the tract of land that I now live on containing one hundred acres, (Known as a part of the Herring land)  Item 3. I give unto my son Jerry Foss and to his heirs ­ assigns forever my tract of land (Known as the Mitchell Place) containing seventy-three acres more of less.  Item 4. I give unto my daughters, Lillian Rouse and Nancy Susan Foss five hundred dollars a piece.  Item 5. That the said lands willed to J. W. and Simon Foss and Jerry Foss are to be held bound for the payment of one thousand dollars to Lillian Rouses and Nancy Susan Foss.   Item 6. That who draws the House part on which I now live shall pay three hundred and seventy five dollars ($ 375.00) of the amount that is due to Lillian Rouse and Nancy Susan Foss and the other to pay three hundred and twenty five dollars ($325.00) of the amt. Due to said Lillian Rouse and Nancy Susan Foss.  Item 7. That the said Jerry Foss shall pay unto the said Lillian Rouse and Nancy Susan Foss three hundred dollars ($300.00)  Item 8. If the said parties that I have willed the land to shall will and truly pay unto Lillian Rouse and Nancy Susan Foss the above amt. Specified for them to pay then these lands shall be their own right and property. But if any of the above named parties that lands is willed to shall fail to pay the amt. That each one has to pay then his part shall be bound for the payment of his part and those that have paid their amts heretofore specified shall not pay any part of the amt. he fails to pay but his land shall be bound for said amt. due by him to Lillian Rouse and Nancy Susan Foss.  Item 9. That the said amt. due Lillian Rouse and Nancy Susan Foss shall be paid in one year after the execution of this will.  Item 10. I give unto J. W. and Nancy Susan Foss two beds and furniture to same.  Item 11. The remainder of my household and kitchen furniture I give unto my two daughters Lillian Rouse and Nancy Susan Foss.  Item 12. I give unto the German or Brethren Church one half acre of land around the church house on the condition viz: said land and house is not to be sold but always kept as a house of worship and to be used for nothing else.  I appoint my son J.W. Foss my executor to this will done in the presence of W. L. Herring B. F.
