Frances Wilkerson 1842 State of North Carolina In Equity Lincoln County The petition of John Robinson and Epps Elizabeth Robinson his wife and Sarah Elizabeth Wilkinson an infant and minor unter the age of twenty-one years who petitions by her guardian Michel Lineberger to the Honorable the Judge of the Court of Equity of said County humbly complain in service (?) unto your Honor that in the year Francis Wilkenson departed this life in said County intestate seized and possessed of a Tract of Land lying in said county and situate on Flat Rock Creek in Said County adjoining the Land of Gabriel Milligan and others containing one hundred and forty-eight acres more or less. That said Francis Wilkerson also left a negro girl named Sinda that he left the Widow Epps Elizabeth Wilkenson him surviving who has since intermarried with John Robinson and hath a right to Dower and a distribut- share of the personal property and one only daughter Sarah Elizabeth Wilkinson of Tender age as aforesaid one of your Petitioners. Michel Linebarger Term (?) of Lincoln Court was appointed administrator of the Estate of said decedent and took upon himself the labor of administering the same and afterwards the same Michel Lineberger qualified as Guardian to the said Sarah Elizabeth. Your Petitioner John Robinson and Epps his wife aforesaid became entitled to Dower in said Land and to one half of said negro Sinda but being of opinion that if dower is laid off of said Land it would diminish the value and also that a sale of the negro Woman Sinda is necessary for the settling said estate and the payment of the distributive portion, the said John Robinson and Epps his wife and Michel Lineberger administrator as aforesaid and Guardian of the said Sarah Elizabeth do pray Your Honor to order adjudge and decreed that the Land aforesaid be sold under a decree of the Honourable Court on such Terms as the Court may deem right and that from the proceeds thereof a full equivalent by law of under the courts direction in lieu of Dower of the said Widow and secured as the Court deems right and they further pray that sale may be decreed of the Negro Sinda as aforesaid land the money arising from said sale be dived according to Law. All your Petitioners representing unto Your Honor that the Verily believe a sale of the realty in manner aforesaid and personalty will be of advantage to all the Petitioners especially the Minor.
