Berry of the said State & County Trustee the Receipt whereof is whereby acknowledged and in further consideration of the purpose herein after expressed hath given granted bargained and sold and by these presents doth give grant bargain and sell alien and confirm to the said Edwin M Berry Trustee his heirs and assigns the following property viz one Sorrell Horse eight years and five head of Cattle 18 heads of hogs one clock household and kitchen furniture farming utensils and the present crop of corn Wheat and Oats To Have and to hold the same to the said E M Berry his heirs and assigns forever and the said J B Glenn doth covenant to warrant and defvend the same to the said E.M Berry against himself and all persons claiming under him and against the claim and claims of all persons whatsoever And the said J B Glenn doth further covenant and bind himself his heirs and assigns that he is seized of the above reacted property in fee simple and hath full power and ability to transfer the same in fee simple & hath hereby transferred the same in fee simple Subject neverthe less to the conditions & provisos herein after contained The condition of the above obligation is such that whereas the above named John B Glenn is indebted to Stanhope H GLenn in the sum of two hundred and fifty dollars bearing date the 15th day of July 1842 and whereas it is the purpose of this conveyance to secure the payment thereof Now therefore of the said John B Glenn shall well and truly pay the said sum of $250 as aforsaid on or before the 15th day of July 1847 then the obligation to be void & of no affect But if the said John B Glenn shall not pay the said sum of $250.00 with the interest theron on or before the 15 July 1847 it is hereby provided and agreed that the aforsaid E M Berry Trustee shall enter upon and possession take of the aforesaid property and the same shall advertise at 3 Public places in said county of Lincoln and shall sell the same at Publick Sale to the highest bidder on the following terms viz. the purchaser to pay down in each of the and out of the proceeds of said sale the said E M Berry Trustee is to pay the said sum of $250. with the interest thereon to the said Stanhope H Glenn with all legal costs and reasonable charges in execution of trust and the surplus if any he is to copay over to the said John B Glenn or order and it is covenanted and provided that untill there is at each of the foregoing provisos so as to onto the said E M Berry Trustee to enter the said John B Glenn is to remain in the quiet possession and enjoyment of the aforesaid property in Witness whereof I have hereunto set my Hand and Seal this the 15th day of July 1842.
