When Humphrey was very young, his father moved from Lincoln County to Burke County, North Carolina. While a resident of Burke County, North Carolina, Humphrey Bates volunteered in 1781, served as private in Captain James McFarland's North Carolina Company, and was discharged after having served a tour of three months. He volunteered again during the same year under the same captain, marched to Sherrill's Ford on the Catawba River where he joined Colonel Charles McDowell's North Carolina regiment against the British and Tories and was discharged after the surrender of Cornwallis after serving a tour of three months. He volunteered in the latter part of the summer of 1782, served as private in Captain John Watson's Company, Colonel Miller's North Carolina regiment against the Cherokee Indians and was discharged after having served a tour of three months or more. After the Revolution, the soldier moved to Rutherford County, North Carolina, and from there to Garrard County, Kentucky, where he remained "upwards of thirty years", thence to Rockcastle County, that state. Humphrey Bates was allowed pension on his application executed November 26, 1832 while residing in Rockcastle County, Kentucky. He died March 23, 1853 in Garrard County, Kentucky. Humphrey Bates married Rachel Mitchel, date not given, in Rutherford County, North Carolina. Their marriage bond dated September 29, 1788 was signed by the soldier and one Going Erwin (no relationship shown) and recorded in the County Clerk's Office of Rutherford County, of which county both the soldier and his wife were residents. The date and place of birth and names of the parents of Rachel Mitchel are not given. Soldier's wife Rachael Bates was allowed pension on her application executed October 10, 1855 at which time she was aged eighty-six years and living about eighteen miles from the county seat of Garrard County, Kentucky. No reference was made in the claim to children. Very truly yours, A.D.
