The Will of Francis Beaty - July Sessions 1830 "In the name of God Amen I Francis Beaty of the County of Lincoln and State of North Carolina being sick & weak but of perfect mind and memory thanks be given unto God calling unto mind the mortality of my body and knowing It is appointed for all men once to die do make and ordain this my last will and testament that is to say principally and first off all I give and reccommend my soul into the hand of Almighty god that gave it and my body I Reccommend to the earth to be buried in a decent christian burial at the discretion of my executors nothing doubting but at the general resurection I shall receive the same again by the mighty power of God and as touching such worldly estate wherewith it has pleased God to bless me in this life I give dismiss and dispose of the same in the following manner and form viz First of all my just debts to be paid I do bequeath to my son FRANCIS a piece of land lying on the east side of Hickory Creek in the county of Rutherford joining lands of ISAAC SPURLIN and JACB G. BEATY I do bequeath to my daughter RUANA Twenty dollars in money out of said land also I do give to my beloved son FRANCIS one rifle gun and all my working tools also the home plantation containing one hundred acres also eighty acres joining the home track and the property to Remain on the place for the use of the family I do bequeath to my beloved wife MARY her support of the said plantation also the house and house hold furniture I do give to my daughter RUANA her claim of the stock I do give to my daughter NANCY and her heirs a piece of land lying on the west side of Hickory creek in the county of Rutherford joining lands of MATHEW SPURLIN JACOB G BEATY also I allow fifteen dollars out of the said lands to my daughter RUANA I do give to my daughter RUANA one weaving loom and Tacklings I do give to my son JACOB G BEATY one dollar To whom I do constitute make and ordain this my last will and testament all and singular my lands messuages and testament them to possess and enjoy and I do hereby utterly disallow Revoke and disannul all every other former testament wills legacies bequeath and Executors by me in any wise before named willed Bequeathed Ratifiing and confirming this and no other to be my last will and testament in Witness whereof I have hereunto set my hand & seal this fifteenth day of February one thousand eight hundred twenty seven Signed Sealed Published Pronounced & declared by the said FRANCI BEATY at his last will and testament in the presence of us who in his presence and in the presence of each other have here-to subscribed our names" test FRANCIS BEATY (SEAL) E B DAVIS MARY BEATY PHILIP SELLERS and FRANCIS BEATY JNR ****************************************** The Will of THOMAS BEATY - July Sessions 1831 "In the name of God Amen I THOMAS BEATY SR of the State of North Carolina & County of Lincoln being of sound & perfect mind & memory (blessed by God) do this fourth day of May in the year of our Lord one thousand eight hundred & thirty one make & publish this my last will & testament in manner following that is to say 1st I give & bequeath unto my son THOMAS Eighty three acres of land the same where on he lived & ten dollars in money, 2nd I give & bequeath unto my son JOHN about Seventy eight acres of land the place where on he now lives during his life & after his death to fall to his heirs at law & thirty dollars in money & also eight dollars to buy his daughter PARNILLA ADALINE a saddle when she arrives at twelve years of age 3rd I will & bequeath to my two sone JAMES & ALFRED one hundred & sixty six acres of my old tract whereon I now live including each part of my meadow land as will be to the right hand of a line running from the piece at the mouth of a ditch along the right hand side of the old meadow to the lower end of said old meadow then straight line to CONNERS corner at the forks of the creek to be divided equally between them 4th I will & bequeath unto my wife SARAH during her life or widowhodd the MARTIN tract & the balance of my old place after deducting the hundred & sixty six acres as above together with the old meadow & also during her life or widowhood to have PAT & SARAH & two horses COBBY & JOLLY & all my stock of cattle sheep & hogs & all my farming tools & if PAT should out live her I will that she should choose her own leave among my children & after her death or widowhood the land and all the other property to fall to my two sons FRANKLIN & EDMOND equally. 5th I will & bequeath to my daughter CAROLINE one hundred dollars in money 6th I will & bequeath to my daughter ASALINE? 1 bed & furniture and white faced cow & calf & one hundred dollars in money 7th I will & order JOE and the waggon to be sold at twelve months credit & the money to go to pay off my debts & any balance of debts to be satisfied out of the crop in the fall & other property above willed to my wife which she may think bill to spare & I will & bequeath to my son ALFRED a sorrel mare called Nance? 9th And I hereby make and ordain my worthy friend ALEXANDER McCORKLE executer of this my last will & testament In witness whereof I the said THOMAS BEATY SR have to this my last will & testament set my hand & seal the day & year above written Signed sealed published & declared by the said THOMAS BEATY SR the testator as his last will & testament in the presence of us who were present at the time of signing & sealing thereof" THOMAS BEATY (SEAL) CHARLES BEATTY Jurat JAMES H. I ISABELLA BEATY of the county of Lincoln and State of North Carolina being of sound mind & memory but weak in body do make and publish this my last Will and Testament in the following manner, that is to say, I give and bequeath to CHARLES BEATTY my only son a note on him for three hundred and seventy three dollars bearing date the twenty eight day of October one thousand eight hundred and nineteen, that if the said CHARLES BEATTY will pay out of said note to his second daughter BETSY ALVIN BEATTY ten dollars and all the rest of his children five dollars to each one which is now in existence the said note above described now in the hands of GILBERT MILLIGAN and payable to me, and one bed and furniture and one writing table one large pot and pot rack hooks too flat irons one stone jug a check reel and all my books except a small Bible 2nd I leave and bequeath to my grand daughter ISABELLA CAROLINE LOFTIN a feather bed and under bed and bedstead one bolster and too pillows one sheet one blanket one coverlet worn some one new one her choice one calico quilt her choice and a white knotted counterpen. And I leave and bequeath to my grand daughter BETSY SALINER LOFTIN one sheet a blanket too coverleds one calico quilt a white corded counterpen these beds and furniture is what I allow for my daughter SARAH L. LOFTIN the mother of the above named my two grand daughters I also leave to ISABELLA LOFTIN one walnut chest and one dinner pot I leave also a large stan of white curtains to my too grand daughters above named to devide as they please I also leave my grandson JAMES FRANKLIN LOFTIN one sheet and checkered counterpen and piece quilt this is part I allow his mother I also leave to my daughter BETSY SALINA LITTLE the balance of my bed clothes and wearing clothes I also leave to my grand daughter LAVINA ISABELLA LITTLE a pine chest I also leave my beds I lie on and cover with bolsters and pillow to be equally divided by my daughter BETSY SALINE LITTLE between JANE CAMILLA and LAVINA ISABELLA and REBECCA ADALINE LITTLEand my grandson JAMES FRANKLIN LOFTIN and my grand daughter BETSY SALINA LOFTIN equally by my said daughter BETSY S. LITTLE to take said beds into to her possession at my death. I also leave all the property if any is under my control coming to me from my sister JANE ALEXANDER'S Estate including money property real or personal of every description to be divided equally in two shares and one share of the two to be equally divided between my daughter SARAHG L. LOFTINS three children and in the other share to be equally divided between my daughter BETSY S. Croock" ********************************************* The Will of MOSES BEATY The following will was written on pages 166 and 167 of "a" Will Book located in Mecklenburg County, NC. The book letter or number was not mentioned on the copy of the original, however, the will was dated 8 Oct 1827 and should be easily located with as much information as has been supplied to us. "In the name of God Amen. I MOSES BEATY of the County of Mecklenburg & State of North Carolina being sick and weakly in body but of Sound mind & memory thanks be given unto God for all his mercies do by these presents make and publish this my last will and Testament in manner & form following - Imprimis - I resign my Soul to God who gave it, and my body to the earth ITEM I will and bequeath to my beloved wife AGNESS BEATY Our Horse, her own choice Saddle & bridle I also will that my beloved wife AGNESS remain in possession of my land & improvements during her natural life or widowhood also our bed and furniture, the Household & Kitchen furniture with all the farming Utensils to Carry on the farm while they live in a family capacity, Also two cows & calves her own choice, also my sheep & hogs for the use of my family, and as much of the crop on hand as will support of my family ITEM I will and bequeath to my beloved daughters MARY BEATY, ELIZABETH BEATY, CORNELIA BEATY, CLARISSA BEATY & SARAH BEATY each one bed & furniture complete, and if my family should remain together they are to make up for ROBERSON? BEATY JENNY? LEE BEATY & ANGELINE M. BEATY the youngest daughter one bed & furniture for each equal to the Beds and furniture given to my other Daughters. I will and bequeath to my son JOHN BEATY One Dollar and all such property as he received before in full of his share of my Estate. ITEM I will and bequarth to my two Sons THOS BEATY & MOSES BEATY the land I now live on Jointly and Severally at the death or marriage of their mother AGNESS BEATY with all the farming Utensils then on hand It is further my will and pleasure that my beloved wife AGNESS BEATY dispose of my clothing among my sons as she may think best. And lastly I do hereby Constitute ? and appoint my trusty friend ISAAC S. ALEXANDER my whole and sold Executor of this my last will and testament & by these presents revoke and disannul all former wills by me made.
