This file was contributed for use in the USGenWeb Archives by: Deanna Thomas t_deanna@hotmail.com ==================================================================== Will of John Bumgarner In the name of God Amen, I, John Bumgarner of the County of Lincoln and State of North Carolina, being of sound mind and perfect memory but being old and calling to mind the mortality of my body knowing that it is appointed for all men once to die do make ordain and establish this to be my last will and testament hereby annulling and revoking all former wills by me made, First, I recommend my soul to God who gave it and my body to the earth to be buried in a decent Christian manner at the discretion of my wife and executors and such wordily estate wherewith it has pleased God to bless me with I will and bequeath and dispose of in manner and form following, Second (?) that my funeral expenses and all my just debts be paid out of my estate by my executors… Third, I will and bequeath unto my beloved wife, Nancy Bumgarner, all the household and kitchen furniture, her side saddle and two horse creatures and four cows of her choice (?). All of my stock, one beef, two breading sows, four sheep, all of her choice, and flower and corn and pork sufficient for one years provision for the family, two axes, one mattock, two ploughs, two hoes that I give and will unto her to dispose of at her decease the land and plantation where I now live during her natural life except that occupied by my son Andrew Bumgarner southeast of Fred Earwood's branch, the wagon and hinds gears and wind mill and cross cut and hand saw all of which at her decease to go to my son Andrew Bumgarner. I give unto her one Negro Woman by the name of Susanna during her natural life then to go to my daughter Michel Bumgarner. I give unto her two more Negroes, one woman by the name of Syrene and one girl by the name of Selah to dispose of at her decease. I give unto her one Negroe boy by the name of Charles during her natural life then to go to my son Moses Bumgarner. I give and bequeath unto the heirs of my son, John Bumgarner, deceast, widow's children in ..?……...before ..?.., John, Charles, Moses, Phillip, Thomas, and daughters Nancy, Elizabeth, Temperance, each of them the sum of five shillings to be paid by my executors as they respectfully become of age. I give and bequeath to my son Moses Bumgarner one mulatto boy, a slave by the name of George and after my wife's decease one Negroe boy by the name of Charles. I give and bequeath unto my son Thomas Bumgarner one Negroe girl by the name of Becky. I give and bequeath unto my daughter Elizabeth Crisel, wife of Andrew Crisel, one Negroe woman by the name of Sukie. I give and bequeath unto my son Aron Bumgarner one Negroe boy by the name of Levy. I will and bequeath unto my son Absolom Bumgarner one Negroe girl by the name of Rose. I will and bequeath unto my son Melcher Bumgarner one Negroe boy by the name of Juney. I give and bequeath unto my daughter Nancy Taylor, wife of Isaac Taylor, one Negroe girl by the name of Minte. I give and bequeath unto my son Andrew Bumgarner all the lands he occupies or chooses to occupy where he now lives beyond the meadow on the said branch from my house on the southeast of which is called Fred Earwood Branch, leaving the meadow on the said branch to that part occupied by my wife and on the decease of my wife my said son Andrew Bumgarner is to have the plantation where I now live and the wagon and gears and wind mill and cross cut and hand saw the whole to him and from him to his heirs forever. I also will and bequeath unto him one Negro boy by the name of Eli during his natural life then to descend to his heirs and also one Negro girl by the name of Juney. I will and bequeath unto my daughter Michel Bumgarner one sorrel mare and her side saddle and one Negro girl by name of Holey and one other Negro girl by the name of Vina and forty acres of land joining William Bandy's and Rocketts lines to her, her heirs and assigns forever. I also will Michel Bumgarner in the line before assigned two cows and the clock. It is my will if that of any of the Negroes herein disposed of should increase before this will takes effect that such increase goes to the persons to whom the Negroes is willed. I also will and bequeath unto Elizabeth Crisel, wife of Andrew Crisel, and Negro girl by the name of Nelley by them pay one hundred dollars for the same Negro. After my decease I allow a sale to be made of all my property of every description of which I may be possessed of that is not herein willed or disposed of, paying my funeral expenses and all just debts and the legacies herein given then the residue and remainder is to be equally divided between and among all my children. I do hereby nominate, constitute and appoint my trusty friend, Gilbert Milligen to be my Executor of this my last will and testament.
