LINCOLN COUNTY, NC - WILLS - James Haynes, 21 May 1842 --------------¤¤¤¤¤¤-------------- James Haynes Will Lincoln County, NC March Sessions 1845 Book 2 ,pp.232 I, James Haynes, of the county of Lincoln and the state of North Carolina, being of sound mind and memory and considering the uncertainty of human life, do this twenty-first day of May eighteen hundred and forty-two make this my last will and testament in manner and form as follows: 1st I desire after my death that all my just and lawful debts be paid. 2nd I give and bequeath unto my son , Robert Haynes and my daughter Sophia Gault, full title to all such property as they already have from me. 3rd I give and bequeath unto my wife, Temperance Haynes all my right title interest and claim to two negroes named Rufus and Mary end their increase (which negroes are now in my possession)for the period of her life and after her death said negroes be sold and the money accruing from the said sale be equally divided between all my children; viz, Robert, Sophia, Daniel, Hillard, Newton, Susan , Belzora provided, however, that my son, Robert, and my daughter, Sophia, have fifty dollars less than the rest of my children of the precedes of said saleon account of what I have done for them. 4th I will and bequeath unto my wife, Temperance Haynes, during her life the following property: viz, all my household furniture consisting of beds, bedstead, and bedding, furniture our side board, one bureau, one set o Windsor chairs,one candlestand,tables and table furniture, also kitchen furniture, farming utensils,books,etc and that said property at her death is to be sold and equally divided between my children as named in the last bequest, provided however that my wife is to have full liberty on marriage of the two youngest daughters , Susan and Belzora to portion off to them the above named property sufficient start in housekeeping and that such property shall be--unto so far as----is concerned. 5th I will and bequeath my carry all and gigg be sold and that if the money derived from such sale be----to pay my debts , that is with all the funds that may be over and above the payment of my debts after collecting what money be due to me at my death be used as s fund for the support and education of my wife and two youngest daughters, Susan and Belzora. 6th and lastly, I hereby revoke and make null and void all my former wills written by me and I constitute and appoint Bartlett Shipp my lawful executor of this my last will and testament.
