Return to the NCGenWeb Archives Table of Contents http://www.usgwarchives.net/nc/ncfiles.htm#NC ************************************************************************ Last Will & Testament of Thomas Hoover Lincoln County Will Book 1, page 280 Written 23 May 1831 Probated 13 Apr 1833 In the name of God, Amen I Thomas Hoover Sr of the County of Lincoln / State of North Carolina being of sound & perfect /mind & memory Blessed be God do this 23rd / day of May in the Year of our Lord one thousand / eight hundred & thirty one make & publish this / my last will & testament in manner following / that is to say First I give & bequeath unto my / son Jacob after my death the plantation / whereon I now live & also the one half of the / pine lands on Shucks branch including the / improvement & also the Jackscrew which he has / received already my desire is that my son / Jacob continue to live in the plantation during / my life & manage the same & that he have / the profits of the same excepting what I shall / want of said Plantation necessary for my / support which I intend to manage myself / The said willed property my son Jacob his heirs & assigns shall have it forever excepting / that my son Jacob shall let my daughter / Elizabeth have the privilege of living with / him during her life or as long as she / remains single in some of the houses & part of Garden & other Truck patches & some / land for cultivation & part of the meadow / sufficient to support two cows & calves but / if he should sell the plantation so that / Elizabeth loses her privileges of the land / and be turned off then the said Jacob shall pay / one hundred dollars to the said Elizabeth / or by disapreeing he shall pay the sum / so that she can go & live somewhere / else but if the said Elizabeth should make it her // choice to give up her privilege of the plantation / to the said Jacob then he the said Jacob shall / pay to her the one hundred dollars but in case / the said Elizabeth shall marry she loses her right & privileges on the plantation but Jacob / is to pay her the hundred dollars _ / Viz I give & bequeath unto my daughter Elizabeth / the one half of the pine land on Shucks branch / to the wood land including Shucks branch & / a negro girl named Harriet, one Beauro, three / beds and bedsteads with the bed furniture belonging to / said beds & also a horse beast of her own choice / out of the horses that will be left at my death / three cows, one table, one Saddle and bridle, one / dough trough with a table plat on it & also a / Sufficiency of Kitchen furniture & common / table furniture for her to keep house & I allow / her to make choice of the kind & quality / that may suit and satisfy her, one spinning / wheel, one big wheel of her choice, three sheep, / three hogs of her choice, also cotton and flax for one / years clothing & all the grain either in the / Barns or field, or crib -, the said Elizabeth / is to have said willed property her heirs & / assigns forever __ / Third I give and bequeath unto my son Daniel the sum of Five dollars him / & his Heirs fore ever __ 4th after my death I direct / all my personal property that is not herein / particularly bequeathed to be sold & equally Divided between my children that shall be named / as follows Solomon, Henry, Philip, Thomas, Jacob, Barbara, Polly, Eve & Sally & I hereby direct / that the willed part of my Daughters shall be paid into / their hands & not to the husband for their support but they / may do with it as they Please // And I hereby make & ordain my worthy friends / Lewis Warlick & David Ramsour T, Executors of / this my last will & testament. I Solomon Huver of the county of Catawba + State of North Carolina. Considering the uncertainty of this life, and being in perfect mi nd +memory, (blessed be God) - do this first day of December in the year of our Lord One Thousand Eight Hundred and forty six make and publish this my last Will and Testament in manner following First I will my body to be buried in a Christian like manner, at the Expence of my personal Estate - 2nd I Will to my Son David Huver my plantation whereon I now live + for him to have possesion after my Death the Same Tract of land lying and being in the County of Catawba and State of North Carolina on the waters of Howards Creek joining lands of Henry Jonas + others Beginning at a Black oak Rudisills corner + Runs with Solomon Shoups line So 80 1/2 E. 109 1/2 poles to a Red Oak in the fork of a branch Shoups corner. Then with his line So. 1/2 W. 81 1/2 poles crossing a branch to a White Oak Stump + pointers then with another of Shoups lines So. 68 1/2 E. 155 1/2 poles to a Stone in the field, then with another of his lines So 20 W. 39 1/2 poles crossing a branch to a Post Oak Stump + pointers, Then So. 72 E. 34 poles to a black Gum on Jonass line. Then No 30 1/2 E. 44 poles to a forked black Oak. Then So 57 E. 40 poles to Hickory Jonases corner, then with his line No 19 E. 138 poles to a black oak his corner, Then No 57 E. 3 1/2 poles to Post Oak a corner of land belonging to the Heirs of Henry Bangel Deceased _ Then with a line of said land No 27 1/2 W. 20 poles to a black Gum near a small branch. Then new lines first S. 50 W 60 poles to a Stake and pointers. Then No. 45 W. 50 poles to a Black oak then No. 47 W. 80 poles to Hickory. Then No. 55 W. 59 poles crossing a new big road to a small black oak. Then So. 88 W. 190 poles crossing a branch to a black oak on or near Rudisills line, Then with said line to the Beginning containing by estimation two hundred + fifty eight acres be the same more or less_ 3rd I Will that my Wife Katherine Huver Shall have full + Exclusive Right in the house + Kitchen wherein I now live during her natural life. 4th I will that my daughter Elviry Huver Shall have a full Right in the house + Kitchen Wherein I now live in comon with my Wife Katherine Huver So long as my Daughter Elviry Huver may live a single life and also to have her support out of the lands (willed to my son David Huver) So long as She may live a single life or continue to live with her Brother David Huver_ 5th I Will that my Son David Huver Shall have the use of my horses Waggon + farming utensils two years after my Death, provided he takes good care of the same + keep the Same in good order _ and at the expiration of two years I will that the Same property So left in the care of my Son David Huver be exposed to sale with the Ballance of all my personal property and the proceeds of the Same be Equally Divided between my three Daughters Malinda, Elmiry + Sally. 6th I Will that my Daughter Elviry Shall have an equal portion with my two Daughters Malinda +Sally. Say three head of cattle + Kitchen furniture, which property is to be Set apart for her by my Executors. 7th I Will nominate and appoint Daniel Seigel Executor of this my last Will and Testament and assigns and I do by these presents certify + confirm publish and declare this my last Will + Testament. _ In whereof I have hereunto Set my hand and Seal the day and year first above written_ Signed seaked and Delivered in the presence of Solomon Yoder Jurat Joshua Lore Solomon Huver {seal} * * * * * * * * Last Will & Testament of Daniel Huber Lincoln Co., NC Will Book 1, page 420 Written 23 Sep 1837 Probated January Sessions 1938 In the name of God amen I Daniel Hoover of the County of Lincoln + State of North Carolina Do make + declare this My Last Will + Testament In manner + form following First I resign my soul into the Hands of Almighty God, Hoping + believing in a remission of my sins by the merrits + mediation of Jesus Christ + my body I commit to the earth to be buried at the discretion of my executor or executors herein after named + My Worldy estate I give + devise as follows First It is my will that my son Daniel Hoover is to have my dark brown horse with a blaze in the forehead + Twelve Dollars in money to buy a saddle + bridle One cow + calf his choise Two head of sheep his choise Second It is my will that my Daughter Anna Hoover is to have my sorrel mare horse three years old with a blaize in the forehead, Two cows + calves her chose, Two head of Sheep her choise, Two beds + bedsteds her choise, one Bureau her choise + Table her Choise + Candle Stand. One small Wheel + One pair of Cards of her choise + Twenty Five Dollars in money to buy a Saddle Bridle + house furniture. It is my will that my son David Hoover is to have my bay mare One Cow + Calf his Choise Two head of Hogs his Choise + Twelve Dollars in money to buy a Saddle + Bridle + Two set of horse geers. It is my Will that my beloved wife Eve Hoover Is to have during her natural life or widowhood the liberty of my dwelling house to occupy + all the other buildings on my plantation Spring + guardin + all the Household + kitchen furniture such excepted as hereinafter + before mentioned the Twenty four hour Clock + Case, The pattint Clock to be Sold her Side Saddle + bridle One Loom and all the apparatus belonging to it, all the Spinning Wheels + cards, Check Reel wash pot Tub Churn +that my wife Eve is to have my Negro boy Ephraim during her natural life or Widow Hood + after her decease the above named property which She may leave to be sold by Executor or Executors +the money arising from the Sale to be applied as herein after mentioned 5th It is my Will that my Son Daniel Hoover Is to have the plantation I now live on + all My land which I have bought Adjoining the Same + about five acres of Meadow Ground Joining Jacob Hoover + Henry Kistler + the Thrashing Machine + my Son David is to provide + furnish my wife Eve with Clothing + provisions sufficient for her decent support during her natural life or Widowhood + Negro boy Ephraim + If my son Ephraim (Ephraim marked through) David Should fail or neglect to provide as above mentioned then my wife Eve shall be at liberty to lease or rent out a part or the hole of his before mentioned lands or plantation to get her decent support during her natural life. Sixth It is my will that the land which I have given to my son Ephraim Is to be valued by three disinterested persons, one to be Chosen by my son Ephrain, + the other two to be Chosen by my Executor or Executors, + If said land is Valued for a less sum in proportion than will be a coming out of the Surplus money which may be left in the hands of My executor or executors, then my Son Ephraim is to have as much as will make him equal in share with my son Absalom, John Hoover, Philip Hoover, Daniel Hoover + my daughter Anna Hoover + If valued as high or higher, then he is to receive no more of my estate. Seventh It is my will that all my property real or personal not above mentioned or herein after mentioned, Is to be sold by My executor or Executors + he money arrising there from to be applied to pay my Just debts + all necessary expenses + the ballance to be equally divided between my children as follows. My sons Absalom, John, Philip + Daniel Hoover + my Daughter Anna Hoover + my son Ephraim Hoover If he is not equal as above mentioned then he is to have his share to make him equal. Eighth It is my will that the money arrising from the property which I have left to my property (property marked through) Wife Eve is to be divided amongst my Children who are named in the 7th article, + as therein directed + it is My Will that three freeholders are to be chosen by my executors, who are to lay off out of my stock, Crop, + provisions, which will be sufficient for the support of my wife Eve, my son David + my daughter Anna + negro boy Ephraim for One Year + no more. Ninth It is my Will that my beloved Son Absalom Hoover + my Trusty friend Daniel Conrad be My executors In witness where of I have here unto Set my hand + Seal 23rd of September 1837 In presence of Paul Anthony Daniel Huber {seal} Daniel Anthony Jurat Executors Sworn State of North Carolina Lincoln County January Sess. 1838 The within Will was proved in Open Court by the Oaths of Paul and Daniel Anthony The Subscribing Witnesses & Recorded Witness H Cansler CC * * * * * * * * Last Will & Testament of Jacob Hoover Lincoln Co., NC Will Book 3, page 2 Written 09 Oct 1856 Probated Jan 1857 session In the name of God Amen. I Jacob Hoover being weak in body but of a sound and disposing mind and memory, do make this my last Will and Testament. I commit my spirit into the hands of God who gave it, my body to be buried in a decent and Christian like manner. With regard to the properth wherewith God has blessed me I dispose of it in the following manner First I will and bequeath unto my beloved Wife Mary M. Hoover all my land and all my personal property during her natural life or widowhood, and at her death the land to be equally divided between my two sons, John and William. I Will each of my children Two thousand dollars, taking into consideration the amount I have already advanced, except my two sons John and William I Will them in addition to the land one thousand dollars each, at the death of my wife the personal property to be sold and divided between my children it is my will that all my children be made equal I hereby nominate and appoint James M. Hoover and Henry F. Ramsour my Executors, and I hereby revoke and disannul all former Wills by me made and declare this my last Will and Testament. Robinson Jurat (Transcriber's note: Jacob Hoover's will was proved in Lincoln County. A copy was also filed in Burke County, North Carolina on 17 May 1860, indicating that Jacob Hoover owned property in that county.)
