In the name of God, amen. I, Conrad Weaver of the County of Lincoln and State of North Carolina, being of sound mind and memory, but calling to mind the mortality of my body and that it is appointed for all men once to die, do this 13 day of July, 1840 make and ordain this my last will and testament as follows--viz--In the first place I commit my Soul to the hand of the Almighty God who gave it and my body to the earth to be buried in a decent and Christian like manner. (To wit) I give and bequeath to my wife Nancy the house and lot where I now live in the Town of Lincolnton called No. 11. I also will and bequeath to my wife Nancy a negro man named Peter about 40 years of age and a negro girl named Darius about 17 years of age--and one horse beast to be her choice of all my stock of horses--also a cow to be her choice and one carry all waggon her choice and harnice and all the liquors of every kind that I may have on hand at the time of my death. I further direct that my wife Nancy shall have full use and possession of the tract of land where Green Hill now lives--meaning the tract I purchased from Ezekial Sullivan which said tract of land my wife Nancy shallhave and hold during her natural life time-- and after her death--said land shall go to the use of my daughter Eve Smith to have full use and profits of said land purchased from said Sullivan till the death of said Eve Smith and at her death said land shall be equally divided between all the children of said Eve Smith--viz--Sally, Caty, Betsey, Harriet, Linny, and Levi--I further direct that my wife Nancy shall have and hold all my household and kitchen furniture that I may have at my death at the place where I now live in Lincolnton and all the tools, grain of every description, hogs, poultry or eatables of every kind that I may have on hand at my death where I now live. I also direct that my wife Nancy shall pay all lawful claims or debts that may come against my said estate. I further direct that all property herein named given to my wife Nancy shall be to her use and at her disposal as she may think proper except the land called the Sullivan tract--or purchased from Ezekial Sullivan. I further direct that money that may remain in the hands of my Executor at a final settlement of my estate shall be paid to my wife Nancy for her use and disposal as she may think proper. I give and bequeath to my daughter Eve Smith--the wife of Cuddias Smith--all the land I hold in the County of Lincoln--except the Lot in Lincolnton already named--and the use given my wife Nancy of the land purchased from Ezekial Sullivan which said Eve and her children--viz--Sally, Caty, Betsey, Harriet, Linny, and Levi--for their joint Benefit during the life of my said daughter and at her death--or after her death to be equally divided between her said Children. And it is my express wish and desire that Cuddias Smith the husband of my daughter Eve Smith--shall have no control, use, or benefit of any of the property herein named given to my daughter Eve or her children. I further will and direct that all money I may have on hand at the time of my death, notes or book accounts when called by my Executor shall be paid over to my wife for her use and disposal as she may think proper. I further direct that one Cow of my stock of Cattle chosen by my Executor shall be given to Harriet Smith a daughter of Sally Smith. As to my two sons John and Levi I have given to them in advancement all the property I intend they shall have or should have. I likewise will and bequeath all the remainder of my estate of every kind not herein mentioned to wife and daughter Eve Smith and her Six children equally during the life of my said daughter and after her death to be equally divided between her six children. And I do hereby constitute and appoint my worthy friend Michael Reinhardt the Executor of this my last Will and Testament and I do hereby revoke and disannul all former Wills and Testaments--and declare this to be my last will and Testament--In testimony whereof have here unto set my hand and seal the day and year herein mentioned.
