Oliver of the County of Fannin and State of Georgia of the one part, and Samuel Foster of the County of Macon, and State of North Carolina of the second part, witnesseth: That for and in con- sideration of Two hundred Dollars in hand paid, the receipt whereof is hereby acknowl- edged, hath bargained and sold and by these presents do bargain, sell and convey the fol- lowing tract or parcel of land, situate, ly- ing and being in the State of North Carol- ina and County of Macon in the 14th Dist. on Commissioners Creek, being Section 22, Beginning at a Hickory tree, South West cor- ner of No. 20, and North West corner of No. 21, running thence West one (hundred?) and twenty poles to a Black Oak; thence South seventy poles to a Hickory, crossing Commissioners Creek at the distance of 22 poles; thence East one hundred and seventy poles to a Chestnut upon the Western line of No. 21; thence North seventy poles to the beginning, crossing Commissioners Creek at the distance 54 poles, together with woods, waters and mines, hereditaments and appurtenances . And the said Thomas W. Oliver doth bind himself, his heirs and assigns to warrant and defend the rights and title from the claim of himself and all other persons, claiming the same to the said Samuel Foster, his heirs and as- signs forever. Oliver, dated Feby, 1855, and being duly sworn says that he cannot make proof of the handwriting of T.W. Oliver, and that he is supposed to be dead. Oliver, for and in consid- eration of the sum of Three hundred Dol- lars to me in hand paid by Samuel Foster have granted, bargained, sold and conveyed and delivered unto the said Samuel Foster a certain par- cel of land being in the County of Macon and State of North Carolina on the West side of the Tennessee River Section 21, in Dist. No. 14, Beginning at a Sycamore upon the bank of the Tennessee River, the Beginning corner of No. 20; thence with its line, thence West one hundred and forty poles to a Hickory, hav- ing crossed the Commissioners Creek at the dis- tance of thirty-three poles, again thirty-seven poles, again forty poles; thence South one Book U-Page 472 hundred and thirteen poles to a post up- on the boundary line between Georgia and N. Carolina, having crossed Commissioners Creek at the distance of sixteen poles; thence with the boundary line East one hundred and seventy-eight poles to a W. Oak upon the bank of said river; thence down its me- anders to the beginning, containing one hundred and seventy-eight acres more or less. And I the said Thomas W. Oliver, for myself, my heirs, executors and admin- istrators and assigns do bargain, sell, de- liver in fee-simple, convey and confirm the above designated tract of land with all and every appurtenances. To have and to hold; and I do warrant and defend the right and title of said land unto the Sam- uel Foster his heirs and assigns forever.
