This deed made this the 10th day of March
1902, by A.P. Foster and wife Alice Foster and
W.A. Foster and wife Cora Foster of Macon
County and State of North Carolina parties
of the first part to J.M. Foster of Macon
County and State of North Carolina partie
of the second part, Witnesseth that the
said A.P. Foster and wife Alice Foster and
W.A. Foster and wife Cora Foster in cons[-]
sideration of an agreement in a divide
of certain Real Estate in which the grant[-]
ors and grantee are heirs in common
have by those presence conveyed to said
J.M. Foster and his heirs and assigns
a certain tract or parcel of land
in Macon County and State of
North Carolina being on the
waters of Commissioners Creek
and adjoining the lands of M.F. Hous[?]
and and others and bounded as follows.
Beginning on a stake thence 
S.34 W37 poles to a White Oak; thence
North 80 W2 poles to a Spanish Oak;
thence S 30 W 94 poles to a stake in
the State Line; thence West with said
line 104 poles to a Hickory; thence N 57
poles to a Hickory; thence N 80-1/2 E 48
poles to a stake; thence N 9 E 67 poles to a

Poplar; thence E 108 poles to the beginning
containing 80 acres more or less.
To have and to hold the aforesaid track or
parcell of land and all priviledges and appur-
tenances thereto belonging to the said
J.M. Foster and his heirs and assigns to
their only use and behoof forever.
And the said A.P. Foster and wife
Alice Foster, W.A. Foster and wife
Cora Foster covenanteth with said J.M.
Foster that they will warrant and def[-]
end the title to the same against the
claims of all persons whomsoever.
In testimony whereof the said parties of 
the first part have hereunto set their
hands and seals the day and date above
written.

I, D.P. Cabe a J.P. hereby certify that 
A.P. Foster & wife Alice, W.A. Foster and
wife Cora appeared before me this day
and acknowledged the due execution of the
within deed of conveyance & agreement
and the said Alice Foster & Cora Foster 
being by me privily examined separately
and apart from their said husbands
touching their voluntary execution
of the same doth state that they
signed the same freely and volun[-]
tarily without fear or compulsion

of their said husbands or any other persons
and that they doth still voluntary assent
thereto, This 10 day of March 1902.
