John Foster and wife M.C. Foster of Macon County, and State of North Carolina of the first part, to A.P. Foster of Macon County, and State of North Carolina, of the second part, Witnesseth: That said John Foster and wife in consideration of the sum of 20 dollars, the receipt of which is hereby acknowledged, has bargained and sold, and by Book KK Page 381 these presents so bargain, sell and convey to said A.P. Foster and his heirs, and assigns a certain tract or parcel of land in Macon County, State of North Carolina adjoining the lands of John Foster, [N.?] F. Howard and others, bounded as follows, viz: beginning at a stake on the upper bank of the Mill race and runs up said Race to the head of Race where it leaves the Creek bed then in a South direction to a Stake and pointers, at the top of the Cliffs on the Ridge, then up the Ridge to Fosters line then East with said line to its corner then to the beginning containing Ten acres more or less. To have and to Hold the aforesaid tract or parcel of land and all privileges and appurtenances thereto belonging, to the said A.P. Foster and his heirs and assigns, to their only use and behoof forever And the said John Foster and wife covenant with said A.P. Foster, his heirs and assigns, that [blank] seized of said premises in fee, and has right to convey the same in fee simple; that the same are free and clear from all incumbrances and that they will warrant and defend the said title to the same against the claims of all persons whomsoever. Foster his wife appeared before me this day, and acknowledged the due execution of the annexed deed of conveyance; and the said M.C. Foster being by me privily examined separate and apart from her said husband, touching her voluntarily execution of the same, doth state that she signed the same freely and voluntarily without fear or compulsion of her said husband or any, other person, Book KK Page 382 and that she doth still voluntarily assent thereto, witness, my hand and official seal, this 8 day of December 1900.
