MACON CO., NC - DEEDS - W. A. and C. M. Foster to Tallulah Falls Railway Company, 1917 ==================================================================== Submitted by Gigi Foster Creel (gigicreel@attbi.com) Macon County, NC GRANTOR Book A-4 Page 420 This indenture made this 8th day of November, 1917, between W.A. Foster and C.M. Foster, his wife, of the County of Macon and the State of North Carolina, parties of the first part, and Tallulah Falls Railway Company, a corporation organized and existing under and by virtue of the laws of the State of Georgia, hereinafter for convenience styled the Railway Company, party of the second part. Witnesseth That the Parties of the first part, for and in Consideration of the sum of One Dollar to each in hand paid by the Railway Company, the receipt whereof is hereby acknowledged, have granted, bargained, sold and conveyed, and by these presents, do grant, bargain, sell and convey, unto the Railway Company, a Right of Way 20 feet in width (that is to say, 10 feet on either side of the center line of the industrial spur tract, hereinafter described,) over and upon the land of the parties of the first part, situate, lying and being in the county of Macon and State of North Carolina, for an industrial spur tract of the Railway Company which will spring from its main tract running between Cornelia and Franklin at a point thereat 2340 feet south of milepost 44, and will extend thence in a North Westerly direction, for a distance of 195 feet, more or less, of which 178 feet, more or less will be located upon the present right of way of the Railway Company for its said main track, and 17 feet more or less, upon the said land of the parties of the first part. To have and to hold the said right of way unto the Railway Company, its successors and assigns, so long as it or they may require the same for the construction, operation, maintenance and repair of said industrial spur tract; Provided, however, and this conveyance is made upon the condition, that in the event that the Railway Company shall, at any time hereafter, [abandon?] the said industrial spur tract, and in evidence thereof shall discontinue the operation of same, and take up and remove the rails, materials and fixtures therein, then an in such event, the right of way hereby conveyed and all rights incident or appurtenant thereto, shall revert to the parties of the first part, their heirs and assigns. Foster, being by me privately examined, separate and apart from her said husband, touching her voluntary execution of the said deed, doth state that she signed the same freely and voluntarily, without fear or compulsion of her said husband, or any other person, and that she doth still voluntarily assent thereto.
