Foster, 1920 ==================================================================== Submitted by Gigi Foster Creel (gigicreel@attbi.com) Macon County, NC GRANTOR Book H-4 Page 72 State of North Carolina, Macon County This Deed, made this the 1st day of July 1920 by and between W.A. Foster of the County of McDuffie, State of Georgia of the one part: and T.J. Vinson of Macon County, North Carolina, of the other part: Witnesseth, that whereas heretofore, the said W.A. Foster, and wife and mother conveyed to said T.J. Vinson by deed dated 14th Sept. 1918, and recorded in office of Register of Deeds of Macon County, in book of deeds “B4” page 357 Certain lands, lying and being in Macon County, North Carolina, and fully described therein; And whereas, said W.A. Foster and Wife and Mother had there- fore, to wit, on the 12th day of October 1917 executed a mortgage to the Federal Land Bank of Columbia to secure a loan of $2000.00 and which said mortgage was recorded on the 17th day of October 1917 in Book #1 Page 1 of the record of home Loan Mortgages and constituted a heir upon a portion of the land above referred to and which said loan constituted a portion of the purchase money in said conveyance to said Vinson, said T.J. Vinson assuming said indebtedness, and whereas, said T.J. Vinson has applied to said Federal Land Bank for a transfer of said loan; Now, therefore in consideration of the [premises?] and the further sum of $1.00 in hand paid to said W.A. Foster, the receipt of which is hereby acknowledged, the sad W.A. Foster has given, granted released, confirmed and quit claimed and by these presents does hereby release said T.J. Vinson, his heirs and assigns the lands described in said mortgage [one line of copy cut off.] Book H-4 Page 73 premises and the appurtenances thereto belonging unto him the said T.J. Vinson, his heirs and assigns to their only use and behoof forever. It is, however, hereby understood and agreed as a part of the consideration hereof that this conveyance is made and accepted subject to a certain mortgage indebted ness evidenced by a note and mortgage given by W.A. Foster, his Wife and Mother to the Federal Land Bank of Columbia, dated 12th day of October 1917, and recorded in Mortgage Book #1, Page 1 of the Register of Deeds, of Macon County, State of North Carolina, and the grantee herein expressly assumes and becomes liable to pay said mortgage indebtedness in full and as provided in and by the terms and conditions of said mortgage. And it is further understood and agreed that the Federal Land Bank of Columbia has consented that the grantee herein may assume and become liable for the payment of the mortgage indebtedness above mentioned, and that the grantor herein be released and discharged of any and all liability whatsoever on account thereof.
