February 22, 1851 Macon County, NC; d. April 30, 1926), married on August 31, 1891, in Macon County, NC, to Rosalee Payne (b. abt 1870). I, Joshua Shepherd, being of sound mind and memory and in the full possession of all my mental faculties but realizing the uncertainty of life and the certainty of death do make and publish this my last will and testament. 1 - It is my will that at my death my body shall have a decent burial consistent with my station in life; and that the same together my funeral expenses shall be paid for out of whatever money or property I may have on hand at the time of my death. II - It is my will and desire that all my just debts, if any I owe, at the time of my death shall be paid out of whatever money or property I may have on hand at the time of my decease. III - It is my will further that my beloved wife Rosa Lee Shepherd shall be taken care of while she lives and that my two sons by her, Norman Dillard Shepherd and Carey Shepherd be charged with the responsibility of looking after her welfare, and I do hereby devise and bequeath to my said wife all my lands and ho__ wherever situated, including my home, during her natural lifetime and at her death the same to 90_ in equal shares to our two sons Norman Dillard Shepherd and Carey Shepherd above named. Carver Leatherman ___ ****************** State of North Carolina In Superior Court Macon County A paper writing purporting to be the last will and testament of Joshua Shepherd, deceased, is exhibited before me, the undersigned, clerk of the Superior Court for said county by Norman Dillard Shepherd the executor therein mentioned and the due execution thereof by the said Joshua Shepherd and J A Carver, the subscribing witness, thereto, who being duly sworn doth depose and say and each for himself deposeth and saith that he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of Joshua Shepherd; that the said Joshua Shepherd, in the presence of this deponent, subscribed his name at the end of said paper writing which is now shown as aforesaid and which bears date of the 27 day of March 1926 And this deponent further saith, that the said Joshua Shepherd the testator aforesaid, did at the time of subscribing his name as aforesaid declare the said paper writing so subscribed by him and exhibited to be his last will and testament, and this deponent did thereupon subscribe his name, at the end of said will as an attesting witness thereto, and at the request and in the presence of said testator and this deponent further saith, that at the same time where the said testator subscribed his name to the said last will as aforesaid, and at the time of the deponent ___ subscribing his name to the said last will as aforesaid and at the time of the deponent subscribing his name as attesting witness thereto as aforesaid the said Joshua Shepherd was of sound mind and memory, of full age to execute a will, and was not under any restraint to the knowledge information and belief of this deponent; and further these deponents say not.
