MADISON COUNTY, NC - WILLS - Enoch Rector, Sr., 11 Aug 1911 ----¤¤¤¤---- Will Book B p. 334 - 337 Madison County, NC Will of Enoch Rector Sr.: p.334 Enoch Rector Sr. Will Madison County, NC I, Enoch Rector Sr. of the aforesaid County and State being of sound mind, but considering the uncertainty of my earthly existence, do make and declare this my last will and testament: First: I give and devise to my two children Klyne Rector and Charles Stewart Rector, all my real estate, situated in the town of Marshall which includes the hotel and stable and the lot between the hotel and stable, and on the south side of Main Street and adjoining Dr. Frank Roberts lot on the West, and N.B. Mc Devitt's on the East, except that Elihu Rector is to have his home without charge in the stable as he now has it during his lifetime. It is my will that as long as my wife, Lucy remains a widow that she live and share with the two children above named on the income of the hotel in whatever way they may see fit to use it to the best advantage. It is my will that if Elihu Rector gets unable to work and gets down sick and in needy circumstances that my wife and children give him some aid in the way of medicine, doctor bills and provisions in order to keep him from suffering. It is my will that Eliza Bryan have one hundred dollars, either before my death or after my death provided she is living at my death. So far as Jane Fisher's Children, Ralph and Hugh, are concerned, I feel like I have been hurt by their parents over and above their part. So far as John Rector's two children, Eugene and Howard are concerned, I feel that I have done more for John their father than I have for the balance altogether. It is my will and desire that in case of the death of either Klyne Rector or Charles Stewart Rector without heirs, then all the property is to revert to my first children or their heirs upon the payment [p. 335] by them to my wife Lucy (provided she does not remarry) twenty percent of the value of the property. In regard to Victor Rector's children, Carl and Raymon, I feel that I have done more than my part toward Vick while he was living and that I cannot control the children and I don't think it is necessary to give them property to throw away when I am gone. I give and bequeath to my two children Klyne Rector and Charles Stewart Rector, all my personal property of whatever nature, including household, and kitchen furniture. My cause for making this kind of a divide was that my little children are yet to raise and that I don't consider Eliza and Elihu will be here long enough to need anything much as they are in bad health at this time. I hereby constitute and appoint my trusty friend, James N. West my lawful executor to all intents and purposes to execute this my last will and testament, according to the true intent and meaning of the same, and every part and clause thereof, hereby revoking and declaring utterly void all other wills and testaments by me heretofore made. In witness whereof, I, the said Enoch Rector, Sr. do hereunto set my hand and seal, this 11th day of August 1911. In the matter of the will of Enoch Rector, Sr., Deceased The paper-writing hereto attached and purporting [p.336] to be the last wil and testament of Enoch Rector, Sr. deceased, is exhibited before the undersigned Clerk of the Superior Court of Madison Co., North Carolina, by James N. West, the executor therein named, and thereupon the following proof therof is taken by the oath and examination of R. N. Triplett one of the subscribing Witnesses thereto, and of J. H. White, as follows: North Carolina, Madison County R. H. Triplett, being duly sworn, deposes and says that he is a subscribing witness to the said paper-writing now shown him, purporting to be the last will and testament of Enoch Rector, Sr., and that he saw Enoch Rector, Sr., execute this writing as his last will and testament, and that affiant attested it in the presence and at the request of said Enoch Rector, Sr., deceased; and that at the time of its execution, said Enoch Rector, Sr., was in affiant's opinion, of sound mind and disposing memory: affiant further swears that H. C. Rector, the other subscribing witness to the said will, signed the same as a witness in the presence of affiant and that affiant saw him sign the same, and that said H. C. Rector now resides out of the State of North Carolina. Signed: R. H. Triplett Subscribed and sworn to before me, this 23rd. day of Sept. 1912. W. H. Henderson, Clerk of the Superior Court of Madison Co., NC North Carolina, Madison County, J. H. White, being duly sworn, deposes and says that he is well acquainted with the handwriting of H. C. Rector, one of the subscribing witnesses to the paper-writing purporting to be the will of Enoch Rector, Sr., deceased, which is hereto attached, dated the 11th day of August 1911, having often seen him write, and that the name of the said H. C. Rector subscribed as a witness to said will is in the genuine hadwriting of the said H. C. Rector; and affiant further swears that he is well acquainted with the handwriting [p.337] of Enoch Rector, Sr., deceased, whose will, the attached paper-writing, dated the 11th day of Aug. 1911, purport to be, having often seen him write, and that the name of the said Enoch Rector, Sr., subscribed to said wil,l is in the genuine handwriting of the said Enoch Rector, Sr.. J. H. White Subscribed and sworn to before me, the 23rd day of Sept. 1912. Wh. H. Henderson, Clerk of the superior Court of Madison County And therefore it is considered and adjudged by the court that the said paper-writing and every part thereof is the last will and testament of Enoch Rector, Sr., deceased, and it is ordered that the same, with the foregoing examination and this certificate be recorded and filed.
