Rector: Last Will and Testament of T. J. Rector In the name of God amen. I Thomas J. Rector of Madison County and state of North Carolina knowing the uncertainty of life and certainty of death, and being of sound mind and memory do make this my last will and testament, thus is to say. 1st having heretofore given off and divided to my beloved children, Alfred Rector, Adolphas Rector, William Rector, Enoch Rector, and Margret Bailey a part of my real estate, which is in my opinion their just part of my realestate. It is therefore my will that they receive no other part of my estate. 2nd I give and bequeath to my beloved wife Anna Rector the following property: one red cow and calf, one iron gray mare called Fannie, all my Hogs, all the house hold and kitchen furniture, one hundred bushels corn and forty [had fifty and crossed out] bushels wheat. 3rd I give and bequeath to my beloved wife Anna Rector for her life the following real property, one tract of land on the case bowl Branch, beginning on a buch [?] and runs South 33 degrees, , West 58 ples to a small hickory thence, East 56 poles to a small poplar, thence South 20 degrees, East 10 poles to an ash then North 76 degrees, East 10 poles to a stake; thence North 23 degrees, West 4 poles to a locust, thence North 17 degrees, West 38 poles to a stake, then north 76 degrees, East 72 poles to a Beach, then North 45 degrees, West 29 poles to a stake, then north 19 degreegs, West 68 poles to a stake, then North 21 degrees, West 33 poles to a stake at the road, then South 45 degrees, West to 80 poles to a stake, then South 72 degrees, East 20 poles to a White Oak., Then North 82 degrees, East 4 poles to a stake [page 107] then South 47 degrees, East 72 poles to the beginning, containing 35 acres more or less. 4th It is my will that the executor of this my will, place in the hands of John A. Nichols, three hundred dollars (and of my money left on hand) and take his sealed note for the same. With interest for the sum at five percent Interest to be paid semi-annually and the principal as follows. Interest to be paid to my beloved wife Anna Rector and one tenth of the principal annually and the residue if any at her death to be divided equally with my beloved daughters Edie Rector, Sarah Ann Arrowood, Eliza Clark, Laura Davis, and Mary Rector. 5th I give and bequeath to my beloved daughters Edie Rector, Sarah Ann Arrowood, Eliza Clark, Laura Davis, Mary Rector and their heirs the following property. One tract of land on Big Pines Creek containing 140 acres adjoining lands of Nathan Davis, Henry Worley, and others. It being the tract now rented by Frederick Russell and for a fuller description, reference is made to a deed from Nathan Roberts to T. J. Rector. Also the balance of the Home tract, excepting the part willed to Anna Rector, on case Bowld Branch adjoining the lands of Willard Robison, Noah Stanley and others and for a fuller description reference is made to a deed from Joseph Rector to T. J. Rector. 6th It is my will, that after the [my-stricken through] death of my beloved wife Anna Rector that the tract of land willed to her for life shall be equally divided between my beloved children Edie Rector, Sarah Ann [Rector-stricken through] Arrowood, Eliza Clark, Laura Davis and Mary Rector and their heirs. 7th I give and bequeath to my beloved daughters Edie Rector, Sarah Ann Arrowed, Eliza Clark, Laura Davis and Mary Rector and their heirs all the money left on hand at my death. After the payment of all my just debts and burial expenses and also all the debts and accts due me. {Over} Page 108 8th It is my further will that if and in event that Edie Rector, Sarah Ann Arrowood, Eliza Clark, Laura Davis, Mary Rector or either of them should die without heirs, that their part of the above property should revert to survivors above named. Ammond, Clerk of the Superior Court, J. M. Gudger who being dully sworn says that T. J. Rector deposited in his hands for safe keeping the forging will and Testament, and that the same have been continuously in his possession and has not been altered or changed while in his possession. Davis and Frank Dockery Personally appeared before me W. {M?} Ammons Clerk of the Superior Court of Madison County, A. E Davis and Frank Dockery, who being [duly-stricken out] each duly sworn, each for him self deposes and says that they were called upon to witness the last will and testament of T. J. Rector, and that the said T. J. Rector after having heard said will read in their presence and the presence of each other stated that it was his will, and that he signed the same in their presence and they witnessed the same in his presence and in the presence of each other. Page 110 Probate of Last Will and Testament of T. J. Rector North Carolina} Madison County} A paper writing purporting to be the last will and testament of T. J. Rector deceased is exhibited for probate in open Court by W. J. Gudger one of the executors therein named and it is therefore proved by the oath and examination of A. E. Davis and Frank Dockery the two subscribing witnesses thereto, who testified that they was called upon to witness said will by the maker himself, and that each for himself stated that he saw T. J. Rector sign said will and that they witnessed the same in the presence of each other, and in the presence of the said T. J. Rector. And it further appearing by the oath and examination of J. M. Gudger that said will of T. J. Rector was placed in his hands for safe keeping by the maker himself and that the same has been continuously in his hands ever since and that it has not been changed or altered while in his possession. It is therefore considered by the Court that the said paper writing and every part thereof is the last will and testament of the said T. J. Rectore. And the same is ordered to be recoreded and filed.
