This file was contributed for use in the USGenWeb Archives by: Ron Haislip Apr 1999 ======================================================================== From the original at: Martin County Courthouse Book B2, pgs 123 & 124 North Carolina Martin County This deed, made this the 12th day of June, 1919, by B.A. Critcher, commissioner, under judgment of the superior court of said county in an action commenced in the Superior Court of Martin County and entitled "Ilda Hathaway, et als. vs. Robert A Powell, et als." party of the first part to Sampson Hathaway and wife, Ilda Hathaway, of Martin County, North Carolina, party of the second part: Witnesseth: That whereas the said B.A. Critcher, commissioner, being thereto licensed by judgment in said action, did on the 29th day of April, 1919, after due advertisement, expose the land hereinafter described, to public sale, at the courthouse door, and then and there the said Sampson Hathaway and wife, Ilda Hathaway, became the last and highest bidder for the said land in the sum of Five Hundred ($500) Dollars and have complied with the terms of the sale. And whereas upon report of said sale to said court, the same was confirmed by the judge of the Superior Court and the said B.A. Critcher, commissioner, was ordered by said judgment to execute a deed in the fee simple to the said Sampson Hathaway and his wife, Ilda Hathaway, upon the payment of the purchase money. Whereas the said purchase money has been paid in full: Now, in consideration of the premises, said B.A. Critcher, thereby bargains, sells and conveys to the said Sampson Hathaway and his wife, Ilda Hathaway, their heirs and assigns, that certain tract of land situate in Robersonville Township, N.C. adjoining the land of Ebron, and others, and divided as follows: First Tract: Beginning at the center of the Canal Branch in the Dogville Road, running thence Northeastwardly along said road to a stake standing three-fifths the distance from the said canal to a gate post of the residence now occupied by T.A. Stevenson, and being 31.28 poles from the said canal; thence running a line perpendicular to said road from said stake north 53 1/4 degrees west 49 poles to a stake; thence running at right angles south 36 1/4 west 56 poles to the Canal Branch; thence down said Canal Branch, the center thereof to the beginning, containing 13 acres. Second Tract: Beginning at an iron stake with several pointers in the Picture Branch; running in a northwesterly direction up said branch to a post, the upper corner of the Powell land; thence running north 10 west 67 1/4 poles to an iron post in the line of the eastern edge of the A.C.L.R.R. right of way; thence running south 10 east 62 1/2 poles to the beginning, containing 18.45 acres more or less. To Have and to Hold said land with its appurtenances to them the said Sampson Hathaway and wife, Ilda Hathaway and their heirs and assigns forever, in as full and ample manner as the said B.A. Critcher commissioner is authorized and empowered to convey the same. In Witness Thereof, the said B.A. Critcher, commissioner, hath hereto set his hand and seal, the day and year first above written, B.A. Critcher Commissioner.
