Will of WARREN BIGGS, dated December 26, 1856, proved July Term, 1866. Martin Co NC Will Book 2, page 550. In the name of God. Amen. I, WARREN BIGGS, of the County of Martin and State of North Carolina, being of sound mind and memory, do make and ordain this, my last will and testament. First, I desire that all my debts should be paid out of my personal estate and the remainder, if any, I lend unto my beloved wife, PENELOPE, during her natural life, and at her death I give the same to my children, share and share alike, to them and their heirs forever. Second, I give and bequeath to my wife also one feather bed and furniture, her (choice?), one trunk and one chest. Third, I lend to my said wife, PENELOPE, the land whereon I now live, being about sixty-two acres, more or less, for the term of her natural life, and at her death I give the same to my two sons, JOHN and ROMULUS, to be equally divided between them, to them and their heirs forever. Fourth, I nominate and appoint as executor to this, my last will and testament, my friend CUSHING B. HASSEL, and hereby fully authorize him to carry out the provisions of the same. BIGGS State of North Carolina} Martin County} Court of Pleas & Quarter Sessions, July Term, 1866 The foregoing paper writing, [purporting] to be the last will and testament of Warren Biggs, deceased, was produced in open court and proved in due form of law by the oath of Jno. D. Biggs, one of the subscribing witnesses thereto, who also proved the death of the other subscribing witness. It is ordered that the same be recorded. C. B. Hassel, the executor therein named, appeared in open court and renounced his right to qualify as executor.
