State of North Carolina Martin County. I JAMES MEDFORD of sound mind and memeory and knowing it is appointed for all to die, do make and ordain this my last will and testement in manner and form following: I give and bequeth unto my beloved son, ITHA MEDFORD, the lot of land known by the name of the Bland Tract adjoining the land of JAMES MAYO and others, containing 40 acres to him and his heirs forever. I give and bequeth unto my next beloved son, ELIJAH MEDFORD the lot of the farm tract of land containing 20 acres to him and his heirs forever. I give and bequeth unto my son, RICHARD MEDFORD a tract of land known by the name of the Register Tract containing 50 acres to him and his heirs forever. I give unto my beloved daughter ABEGAIL MEDFORD one half of Land that I now live in. The half tract containing 22 acres, her half to include my dwelling home. I lend everything appertaining thereto and my house hold and kitchen furniture to her during her life and remaining years, and after her death, or marriage, I give and bequeth unto my beloved son WILLIAM MEDFORD the same house and land I have left unto my daughter, ABEGAIL to him and his heirs forever. I give and bequeth unto my beloved son, THOMAS MEDFORD the other half of the plantation that I live on, containing 26 acres to him and his heirs forever. I give and bequeth unto my grandchild SALLY ANN CHERRY, one bed and furniture and one spirited horse to her and her heirs forever. I also lend unto my befor mentioned daughter ABEGAIL MEDFORD one cow under the same terms that I lend her my Lands and appertainings. I give and bequeth unto my beloved daughter ELIZEBETH MEDFORD twenty dollars to her and her heirs forever. Its my will and desire that the balance of my tract of cattle, hogs, tack and horses not mentioned before to be sold and the money assying there from after having made my death debt and the Twenty Dollars given to my daughter ELIZEBETH. For the blanace to be equally divided among all my children. It is my will and desire that all my handcrafts and kitchen furniture that I have had to my daughter ABEGAIL MEDFORD after her death or marriage to be sold and the money arriving therefrom to be equally divided between all my children as before. Truly, I do nominate and appoint my son ITHA MEDFORD as Curator to this my last will and Testement revoking all other wills in my name whatsoever. In witness, wherein I have set my hand and seal in the year of our Lord 1833, January 5th. his Signed in witness JAMES X MEDFORD EDWARD HAMMONS mark FRANK HODGES State of No Carolina Court of Pleas and Trusteeship Martin County January Sessions 1834 The foregoing paper writing purporting to be the Last Will and Testament of JAMES MEDFORD due, was produced in open Court and known in due form of Law by the oath of EDWARD G HAMMONS one of the inheriting witnesses thereto- whereupon ITHA MEDFORD the Executor named therein came forward and took upon himself the burden of executing the same by taking the oath required by Law for qualifying Executors has noted this instrument and there fore was found to be sound.
