Court Records Written: October 11, 1843 Recorded: November 1844 In the name of God Amen John M. Fulwood of Mecklenburg County, North Carolina, being in a low state of health but through the mercy of God of sound and disposing mind and memory, do make and ordain this my last Will and Testament in the manner and words following First, I commend my Soul to God, through the mercy of Christ, and my body to the ground to be buried at the discretion of my family-the property with which it has pleased a kind Bondsman to favour me I approve of as follows. 1st I will and bequeath to my beloved wife Elizabeth B. the plantation on which I now live with all the improvements and appurtenances thereto belonging during the term of her continuing my widow or of her natural life, with liberty of selling said plantation at any time, with the consent & by the advice of my executors, shall have person to make title to said plantation and to buy with the price thereof, any other place for the settlement of my family which my wife and said executors may think desirable and such plan purchases shall be to the use of my wife and family as the place I now live on should have been. Item 2 I will and bequeath to my beloved wife all my stock of horses, cattle, hogs and sheep for the use and support of herself and my children during the widowhood of my wife. Item 3 I will and bequeath to my wife Elizabeth all my household and Kitchen furniture, Beds and Bedding, Bureaus and cupboard together with my waggon Gear and farming tools of every kind during her widowhood out of which she is to portion my children, as she may be unable as they come of age or marry, and in case of my wife's death, all the above specified property and stock and furniture, I will and bequeath to my surviving children to be equally devided among them Share and Share alike. Item 4 I will and bequeath to my wife all my present standing crop and provisions on hand, for her years of support and the support of my children Item 5 I will and bequeath to my wife Elizabeth my negro man Jacob during her widowhood and at her death or marriage to be sold and the price to be equally divided between my children Item 6 I will and direct that all my just and lawful debts be paid by my executors out of the monies due us and my interest in the store now kept by Amos Stevens on 12 Mile Creek. Item 7 I will and direct that Jackson House have the use of the tract of land on which he know lives four years from the 1st of January 1844, which was the bargain with him for improving the place. The said tract of land lying on Goose Creek. Item 8 I will and direct that at the expiration of the term for which the said House has a claim on my land as above specified lying on Goose Creek my executors dispose of said land, as they may think best for the interest of my children. Item 9 I hereby appoint and constitute my trusted friend William D. Howard, Amos Stevens executors of this my last Will and Testament, In Testimony, whereof I have hereto Set my hand and affixed my seal this 11th day of October 1843.
