This indenture made the 1st day of February in the year of our Son One Thousand Eight Hundred & Fifty Three Between John J Donaldson of the State of Maryland by William J Brown agent for him & his heirs & representatives of the one part & George Cooke Hobson of the County of Yancy & State of North Carolina of the other part witnesseth that this John J Donaldson by William J Brown agent as aforesaid for & in consideration of the sum of twenty five dollars to him in hand paid by the said George C Hobson The receipt whereof the said John J Donaldson by William J Brown his agent as aforesaid doth hereby acknowledge hath given, granted, bargained & sold aliened & confirmed & by these presents doth give, grant, bargain & sell alien & confirm unto the said George C Hobson his heirs and assigns forever all that tract piece or parcel of land situate lying & being in the County of Yancy and State aforesaid on Little Rock Creek adjoining lands of John Hobson & others. Beginning on a small spruce pine at John Hobson's locust corner the North Bank of said Creek & runs North 60 degrees West down the meanders of said Creek to the mouth of a small Branch near the foregoing Road in William Philips line then South with said 100 poles to a Spanish Oak on the point of a ridge at Philips corner a stake thense with said line 60 poles to a Maple at Phillips corner a stake & in the line of Philips upper 38 acre survey thense South 75 East with said line 48 poles up a ridge to hickory on said ridge & in the line of said Phillips upper 50 acre survey thence North East with said line 48 poles to a small hickory at Phillips Corner Stake of survey thence south to West with said line 15 poles to Chestnut Oak in said thence East 13 poles to a white oak said George C Hobson corner thence with said line 100 poles to a chestnut oak said Hobsons beginning corner of his hundred acre tract then East with John Hobsons line 230 poles to a Ash John Hobsons Beginning Corner thence South 78 West with said line -------- poles to a white oak John Hobsons corner thence South 140 poles with said line To be the Beginning Containing One Hundred & Eighteen Acres & also all the woods, waters & water courses & all & every the apperteniances thereunto belonging or anywise appertaining & the reversion & reversious remainder and remise, rents, Issues & proffits of the aforesaid lands & premises & every part thereof All the estate right title interest claim property & demand whatsoever of the said John J Donaldson as aforesaid of in & to the lands & premises hereby granted to have & to hold the aforesaid lands and premises with the appertenances unto the said George C Hobson his heirs & assigns to the proper use & behoof of the said George C Hobson his heirs & assigns forever & the said John J Donaldson by his agent William J Brown as aforesaid land & premises & every part thereof against him & his heirs & claim or claims of all & every other person or persons whatsoever claiming by and through him the said John J Donaldson to the said George C. Hobson his heirs & assigns shall & will forever warrant & defend by these presents Reserving however condition that the mines & minerals remain to the only proper use & behoof the heirs & representatives aforesaid In Witness Whereof the said John J.
