Probate of Will

State of North Carolina )  In the Superior Court
Mitchell County         )

   A paper purporting to be the last will and
Testament of Wiley Gouge deceased is ex
hibited before me the undersigned Clerk
of the Superior Court for said County by Edy
Gouge heir therein mentioned and the
due execution thereof by the said Wiley
Gouge is proven by the oath and examination
of D. M. Cook and B. V. Hughes, the Subscribing
witness thereto who being duly sworn doth
depose and say, and each for himself de
poseth and sayeth that he is a subscribing
witness to the paper writing now shown
him purporting to be the last Will and Testament
of Wiley Gouge that the said Wiley Gouge
in the presence of this deponent subscribed
his name at the end of said paper writing
which is now shown as aforesaid and
which date of the 10th day of April 1910.
   And the deponent further sayeth that
the said Wiley Gouge the Testator aforesaid
did at the time of subscribing his name
as aforesaid declare the paper writing
so subscribed by him and exhibited to be
his last will and Testament and this depon
did thereupon subscribe his name at the
end of said will as an Attesting witness
thereto and at the request and in the pres
ence of said Testator and this deponent
further sayeth that at the same time
when the said Testator subscribed his
his name to the said last Will as afore
said and at the time of the deponent 
subscribing his name as an attesting
witness thereto as aforesaid, the said
Wiley Gouge was of sound mind and memory
of full age to execute and was not under any
restraint to the Knowledge information
and belief of this deponent, and further
these deponents say not.

     It is therefore considered and adjudged
by the Court that the said paper writing and
every part thereof is the last Will and Testa-
ment of Wiley Gouge decease. Let the said
will together with the probate be records
and filed.
     This 15 day of Aug. 1910.

      This will made this 10th day of April
1908 by Wiley Gouge of Mitchell County and State
of North Carolina to his Sons to L. H. Gouge he
wills $5.00 in cash to William Gouge he wills
$5.00 to M. L. Gouge he wills $5.00 to Hoy Gouge he
wills $5.00 in cash and to Geo. Gouge he wills $5.00 in
Cash to Edy Gouge he wills all his land and
all his property cows mules and wagon
and all the House hold and Kitchen furni
ture and all the money that he has in the
Bank and on hand the condition of this
will is such that the said Edy Gouge shall
keep and maintain as long as they live Wiley
Gouge and Millie and John Gouge Keep them
comfortable Clothes and plenty of rashens
and medicine such as needed The $5.00 to be pd
all the boys at the said Wiley Gouge death.
