McInturff, deceased North Carolina } Superior Court Mitchell County} Before the Clerk This day personally appeared before me, the undersigned, Clerk of the Superior Court for said county, Charles B. McInturff, the Executor named in the Last Will & Testament of E.W. McInturff, deceased, as it purports to be and being duly sworn, deposes and says: That E.W. McInturff is dead, leaving a Last Will & Testament, and that the Estate of said E.W. McInturff, deceased consisting of Real Estate, Live Stock, household & kitchen furniture &c. is worth as far as can be ascertained, at this time, about $1000.00 and that Omie McInturff, Chas. B. McInturff, T.C. McInturff, Claton McInturff, Geo. McInturff are the Legatees therein named. Charles B. McInturff Sworn to & subscribed before me the 20th day of Jan. 1902 J.C. Bowman, C.S.C. State of North Carolina } S.S. in the Superior Court Mitchell County } A paper-writing purporting to be the Last Will & Testament of E.W. McInturff, the deceased, is exhibited before me, the undersigned, Clerk of Superior Court for said county, by Charles B. McInturff, the Executor therein mentioned and the due execution thereof by said E.W. McInturff is proved by the oath and examination of W.L. Lambert & John Slagle, the subscribing witnesses thereto, who being duly sworn, doth depose & say each for himself deposeth and saieth that he is a subscribing witness to the paper-writing now shown purporting to be the Last Will & Testament of E.W. McInturff in the presence of this deponent subscribed his name at the end of said paper writing now shown as aforesaid and which bears the date the 9th day of Jan. 1902. And the deponent further saieth that the said E.W. McInturff, the testator aforesaid, did, at the time of subscribing his name as aforesaid, declare the paper-writing so subscribed by him and exhibited to be his Last Will & Testament and this deponent did thereupon subscribe his name at the end of said will as an attesting witness thereto and at the request and in the presence of said testator. And this deponent further saith that at the said time when the said testator subscribed his name to the said Last Will as aforesaid and at the time of deponents subscribing his an attesting witness thereto, as aforesaid, the said E.W. McInturff was of sound mind and memory, of full age to execute a will, and was not under any restraint to the knowledge, information, or belief of this deponent and further these deponents say not. W.L. Lambert Severally sworn and subscribed this 20th day of Jan. 1902 before me J.C. Bowman, C.S.C. North Carolina } Superior Court Mitchell County } Before the Clerk In the matter of the Last Will & Testament of E.W. McInturff, deceased. It appearing to the Court, by the oath and examination of W.L. Lambert & John Slagle the subscribing witnesses thereto that the paper-writing propounded by Charles B. McInturff, the Executor therein, is the Last Will & Testament of E.W. McInturff, and that the same was duly Executed by the said E.W. McInturff in the presence of said witnesses, and that at the time of signing the said E.W. McInturff was of sound mind. It is therefore adjudged that the said paper writing be admitted, to probate as the Last Will & Testament of E.W. McInturff & the Executor therein named qualify as such. This 20th day of Jan. 1902 J.C. Bowman, C.S.C. Last Will & Testament of E.W. McInturff State of North Carolina } Superior Court Mitchell County } I, E.W. McInturff, of the aforesaid county and state being of sound mind but considering the uncertainty of my earthly life & existence, do make and declare this to be my Last Will & Testament. First: That Charles B. McInturff shall give my body a decent burial, suitable to the wishes of my friends & relatives & pay all funeral expences, together with all my just debts, out of the first money coming into the hands of Charles B. McInturff Second: I give and devise unto my beloved brother Charles B. McInturff, at my death all my property both real and personal, reserving, however, to my beloved wife Omie all my household & kitchen furniture. Third: I give and devise unto each of my brothers and sisters, one Dollar to be paid by the aforesaid Charles B. McInturff at my death. Fourth: It is further my will and desire that my beloved wife Omie shall have a comfortable and reasonable support out of the property heretofore devised to my brother Charles B. McInturff during the widowhood of my said wife Omie - the said amount for the support of my said wife to be paid her by the said Charles B. McInturff at such time as she may need it.
