MALCOM M. LEACH, Adm'r.
     vs.
NATHAN SMITH, WILLIAM SMITH and others

Petition for Settlement and Account

In this case, it appearing to the satisfaction of the Court that the 
defendant, WILLIAM SMITH, resides beyond the limits of this State, it is 
therefore ordered by the Court that publication be made for six successive 
weeks in the North Carolina Argus, a newspaper published in the Town of 
Fayetteville, notifying said defendant to be and appear at our next Court of 
Pleas and Quarter Sessions to be held for the County of Montgomery at the 
Court House in Troy on the lst Monday in December next. Then and there to 
plead, answer or demur to this petition filed, otherwise judgment will be 
taken pro confesso and heard ex parte at to him. Witness, JOHN McLENNON, Clerk 
of said Court at office in Troy, on the 1st Monday in October A.D., 1856.
