Item 2- North Carolina Montgomery County County Clerks Office March 7th, 1857 Application for special letter of administration in the estate of Mary Parker having been made to the undersigned on this day we have granted the same to Mason Parker, he having entered into bond in the sum of $15,000 with Benjamin Deberry as his security and we have ordered the said mason Parker special Administrator of aforesaid to sell the following property in a credit of nine months two head of Horses, stock of cattle, hogs, and sheep, house kitchen furnishings corn & fodder & oats, the old horse wagon, lit of blacksmith tools, two stands, of (unreadable) three oxin white bacon & lard and all the farming tools one (unreadable) & (unreadable). Haltom, JP Neil Gillis, JP Item 3- North Carolina Montgomery County Know all men by these presents that we Mason Parker and Benjamin Deberry are held and firmly bound unto the state of North Carolina in the sum of Fifteen Thousand Dollars to the which payment will and truly to be be made and done we bind ourselves, our heirs, administrators, Executor, and assigns. Jointly and severally, firmly by these presents. Sealed with our seals, and dated this 7th day of March 1857. The condition of the above Obligation is such, that whereas Mary Parker late of this County of Montgomery aforesaid has lately died leaving no last will and testament and whereas her estate is in such condition as to require the immediate supervision by some discrete person. And whereas at a special court this day held at the office of the County Court Clerk by William H. McRae, Steven Haltom and Neill Gillis three of the acting Justices of the peace in and for said county the above bounder Mason Parker has been appointed special administrator of said estate with authority to sell certain articles of stock and personal estate property and to take charge of all personal property of his said intestate until the next term of the county court. Now of the said Mason Parker shall sell this property ordered of said court to be sold and shall return a list of said sale to the next term of the county court to be held for said as well as an inventory of all such other property as shall come into his hands belonging the estate of his intestate and shall deliver over to wherein the court may appoint administrator all the effect and estate of his intestate or shall come into his hands. Mary Parker Bond 7th April 1857 State of North Carolina Montgomery County Know all Men by these Presents, That we, Mason Parker and Benjamin Deberry are held and firmly bound unto the State of North Carolina, in the sum of Fifteen Thousand Dollars, current money, to be paid to the said State; to which payment, well and truly to be made, we bind ourselves, our heirs, executors and administrators, jointly and severally, firmly by these presents. Sealed with our seals, and dated this 7th day of April A. D. The Condition of the above Obligation is such, That if the above- bounden Mason Parker Administrator of all and singular, the goods and chattels, rights and credits of Mary Parker deceased, do make, or cause to be made, a perfect inventory of all and singular, the goods and chattels, rights and credits of the deceased, which have or shall come to the hands, knowledge, or possession of any person or persons, for him and the same be made, do exhibit, or cause to be exhibited, one attested copy thereof, to the County Court, where orders for administration passed within ninety days after the date of these presents; and the same goods, chattels and credits, and all other goods, chattels and credits of the deceased at the time of his death, or which will come into the hands or possession of the said Mason Parker or into the hands or possession of any person or persons for do well and truly administer according to law; and further do make, or cause to be made a true and just account of his said administration, within two years after the date of these presents, and all the rest and residue of the said goods, chattels and credits, which shall be found remaining upon the said administrator account, (the same being first examined and allowed by the Governor and Council, Superior or County Court,) shall deliver and pay unto such person or persons respectively, as the same shall become due, pursuant to the true intent and meaning of the act in that case made and provided. And if it shall appear that any will or testament was made by the deceased, and the executor or executors therein named do exhibit the same into Court, making a request to have it allowed and approved accordingly, if the said Mason Parker above bounden, being thereunto required, do render and deliver the said letters of administration (approbation of such testament being first had and made in the said Court,) then this Obligation to be void, otherwise to remain in force and virtue.
