Haywood, Deputy Clerk of the Superior Court of said State and County, do hereby certify that the foregoing is a true and correct copy of the petition for removal and order for removal in the matter of the last Will and Testament of T. Haywood, of the aforesaid County and State, being of sound mind, but considering the uncertainty of my earthly existence, do make and declare this my last will and testament. First. My executors herein after named shall give my body a decent burial suitable to the wishes of my friends and relatives, and pay all funeral expenses together with all my just debts out of the first moneys which may come into their hands belonging to my estate. Secd. That my Executors hereinafter named shall sell all my personal property publicly or privately as seems best and collect all debts owing to my estate, and pay all my just debts I may owe. Third. It is my will and desire that all notes and accounts due me or my estate by any of my heirs shall be deducted from their share or part of my estate. Forth. It is my desire that all my children share equally and alike in my estate. Fifth. It is my will and desire that my beloved sons, namely, John F. Haywood, William F. Haywood, Presley Haywood’s children, E. T. Haywood, Allie O. Haywood & Cabble Haywood have my real estate at the following prices: namely Home place and all improvements, encluding dwelling house and all out houses, gin house, cotton house, engine and cotton screw (?) at $1500 (to Cabble Haywood above) my Dumas place at $1200 one thousand two hundred dollars, my Robinson tract at $2500, two thousand and five hundred dollars, my Strough (?) $100, one hundred dollars, my Ledbetter tract at $150 one hundred and fifty dollars, my Jarrel land at $2100, two thousand one hundred dollars, my house and lot in Mount Gilead $1250 one thousand two hundred and fifty dollars, my James Byrd tract at $150 one hundred and fifty dollars. Sixth. It is my will and desire that my sons named above pay over to my beloved daughters Annie Eliza Whilhoit, and Mary F. Bruton and Elizabeth L. Byrd’s children, their proportionate part in real and personal property in money or its equivalent. Seventh. It is my will and desire that my daughter, Annie Eliza Whilhoit, have my house and lot in Mount Gilead, NC. if she so desires as part of her share at $1250, one thousand two hundred &fifty dollars. Eight. I will and desire that my executors pay to Elizabeth L. Byrd’s children, namely Bud Byrd, John Byrd, Thomas P. Byrd, Docking Byrd, Martha Morton, Callie Robinsons children and Janie Thompson their share each as they become 21 years old or as their necessities require. Ninth. I hereby constitute and appoint my trustworthy sons John T. Haywood and William F. Haywood my lawful executors to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof hereby revoking and declaring untterly void all other wills and testaments by me heretofore made.
