Elliott Heirs at law To the Honorable, the Superior Court for said County: The petition of Casan Saunders widow of P.C. Saunders in respectfully showeth that her late husband died intestate in Montgomery County, during the month of November last, leaving him surviving the following children, Viz. B. H. Saunders, A. C. Davis, wife of E. F. Davis, M.J. Barton wife of Daniel Barton, R.E. Henderson, wife of Madison Henderson J. S. Saunders, A. H. Saunders, M. M. Morgan wife of George Morgan, A. H. Saunders, Montie Morgan, minor heir of ___ Morgan decd., J. K. Saunders, and E. L. Elliott wife of John Elliott, who are his only heirs-at-law and of whom the said Montie Morgan is an infant under twenty one years of age, and without any guardian. And further that all the above natural heirs are residents of the County of Montgomery except B. H. Saunders who is a resident of Cabarrus County, and M. J. Barton wife of David Barton who is a resident of Forsyth County and Montie Morgan who is a resident of Davidson County. Two petitioners further showeth that her said husband during his with the petitioner was in fee simple and possession of the following real estate to wit: One tract in east side of Uwharrie River and adjoining land of Julian Summers, A. L. Henderson, B. T. Coggins & others containing 155 acres. Also ½ undivided interest in a tract of land on west side of Uwharrie River known as the Nelson Russell Mill tract, on joining lands of Nelson Russell, G. M. Hearne & others containing 50 acres. 3rd One tract on waters of Islody Fork of Beanes Davis Branch known as the Thos. Stokes mill Tract, or joining lands of Frank Russell, William Russell & Julian Hamilton, containing 22 acres. 4th One tract on waters of Beanes Dave branch known as the Taylor & Henderson Mill tract, adjoining lands of Columbus Taylor, John Keith and heirs, containing 5 ¼ acres. 5th One tract on waters of Barnes Creek known as the Heulin lands, adjoining the lands of Joshua Cranford & others containing 100 acres. All the above described lands being situated in the County of Montgomery 5th ¾ interest in a tract of land in the County of Randolph, known as the Shaw lands in the waters of Poison Fork branch containing 160 acres. Your petitioner desires to have her dower in said lands allotted to her and to that end she pray you honor to issue a writ to the sheriff, commanding him to summon three, unless one of the parties demand a fraction numbers and there not more than twelve freeholders, connected with the parties neither by consanguity or affinity, entirely disinterested and qualified to act as Jurors to view the said land, and to allot to her one third part thereof, including the dwelling house and all out houses, buildings and improvements appertaining thereto, for the term of her natural life, and to export this proceedings in due form of law. May if please his honor to issue subpoena to said defendants and appoint a proper guardian ad litem for the independent? Montie Morgan requiring them to appear before you within twenty days from the service of this papers and show cause if any they can, why the prayer of your petitioner shall not be granted.
