This file was contributed for use in the USGenWeb Archives by: Lydia Sides lsides@ac.net *************************************************************** Will of Patrick Thompson - Montgomery Co., NC LAST WILL AND TESTAMENT OF PATRICK THOMPSON I Patrick Thompson of the county of Montgomery and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existance do make and declare this my last will & testament in manner & form following that is to say first that my executor herein after named shall provide for my body a decent burial suitable to the wishes of my relatives & friends & pay all burial expenses together with my just debts howsoever & whomsoever owing out of the monies that my first may first come into his hands as a part or parcel of my estate. Item 1st I give & devise to my beloved wife one hundred acres of land whereon I now live twenty head of sheep all my stock of hogs & my house hold & kitchen furniture all my stock of cattle & my bay mare & also what money that is due me after my debts are payed. Item 2 d I give & devise to Martin Thompson thirty acres of land to be laid off in a compact body around his house that he now lives in it being a part of the 100 A tract that is left to my wife & also thirty five acres of land I purchased of D. D. Deberry one cow & calf & four sheep to said property to be taken at the death of my wife. Item 3 d I give & devise to Washington Thompsons heirs equally one fourth of my stock of hogs, one fourth of the stock of my sheep one forth of the stock of my cows & one forth of all the balance of my property at the death of my wife. Item The 4th I give & devise to Washington Thompsons son Richmond Patrick one bay mare at the death of my wife. Item The 5th I give & devise to Sarah Thompson heirs equally one fourth of my cows at the death of my wife. Item The 6th I give & devise to Martha Thompson heirs equally one fourth of my sheep one fourth of my hogs & one fourth of my cows at the death of my wife. Item The 7th and at the death of my wife & after the above named property is taken out it is my desire that the remainder if any be sold by my executor & devided between the heirs of Martha Thompson, Sarah Thompson Washington Thompson & Martin Thompson if he has any heirs. Item The 8th in case Martin Thompson dies without an heir all the property I have left him it is my desire for it to be given to Washington Thompson son Richmond Patrick. Item The 9th I give & devise to Washington Thompson son Richmond Patrick all the tract of land whereon I now live except what has been before disposed of - and lastly I do hereby construct & appoint Washington Thompson my lawful executor to all intents & purposes to execute this my last will & testament according to the true intent & meaning of the s__ & every part & clause thereof hereby revoking & declaring utterly void all other will & testaments by me heretofore made in witness whereof I Patrick Thompson do hereunto set my hand & seal this the 8th of November 1858 - signed sealed published & declared by the said Patrick Thompson to be his last will & testament in the presence of us who at his request & in his presence do subscribe our names as witness thereto.
