Will Book B, pp. 112-115. In the name of God, Amen. I, Peter Shamburger of Moore County, North Carolina, being weak in body, but of Sound mind, memory, And Understanding Blessed be God. Do this Jan 18, 1838 Make and publish this my last Will and Testament in manner and form following. Item 1st I give to my beloved wife Lydia Shamburger All my home Place whence my Dwelling house stands, from a certain crop fence near the title line, Up the Creek as far as my Land Extends. During her natural life in Widowhood With all my family of Negroes, Riz, Arch, Pat, Temp, Joe, Tina, Savine, Luce, Gince, Tice, Aaron, Karoe and Willis, for the term of 5 years from this present date at Which time My younger child Peter Shamburger Will be of the age of 21 years, or in case she marry within the 5 years then the property be considered in the hands and at the control of My Sham Executors hereafter to be names -- And 4 head of horses, 2 wagons, 2 carts, 1 Set of Loges huts To remain for the use of the farm and family as heretofore has been, Together with my farming tools, Household and kitchen furniture of every kind and description. Also my stock of cattle, hogs and Sheep, with the execption of the surplus to be judged of by my Executors, at each times, And in such ways as they may think proper to the use of Sd Family, but incase Martha or Peter Shamburger Should Need help within the above 5 years, My Will is that my Executors help them as has been done to and for the other Children. 2nd My Will is that my land on Willian Cr and Waters of Bear Cr below the Sd Crop fence near the Letts gin be in the hands and control of My Son Peter Shamburger for the space of the 5 Years, then and at the Expectation of Sd Time, the aforesaid Lands and premises to be managed together with the above Lands Tenements and house willed to My Wife Lydia Shamburger so long as it may be managed by her consent And at the division fo the Negroes That my Executors give my wife Lydia Shamburger first choice out of the above named Negroes to possess during her life And at her death my Will is that Sd Negros be divided between my Daughter Sarah Moody, Peter Shamburger and Martha Shamburger Share and Share alike with my other Negroes. Item 3rd I give the heirs of my son John Shamburger $1. Item 4th I give My daughter Mary Lawrence $5. Item 5th I give my daughter Sarah Moody all my Interest in the Lands willed to me and my brothers John Shamburger, Henry Shamburger and William Shamburger by our father Peter Shamburger Sr, Viz one fourth of Sd Lands and premises to have and to hold unto Sarah Moody and her heirs and assignees forever. Item 6th I desire to My Executors to be Mentioned to the use of my daughter Mary Lawrence the Sum of $450 to be detained in the hands of my Executors payable by them at their discretion at such times and in such sums as their opinion will be most advisable so to do And if during her natural life the whole of the Sum of $450 should not be paid over the balance then remaining in the hands of the Executors is to be paid unto her children in equal Distribution when they arrive at the age of 21 years. Item 7th In the decree Made to my Wife Lydia Shamburger of Lands and other property During her life or widowhood, it is my will that the whole of Sd Land and premises after my Wife's Death be fully Vested in my Son Peter Shamburger and his hears forever--And after my Wifes Decease it is my Will that all the personal property which She may die in possession of to be Equally Divided between my Son Peter Shamburger, my Daughter Sarah Moody, and my Daughter Martha Shamburger, Share and share alike. Item 8th I give my Son William Shamburger 1 Negro Child to be Worth about $200 on condition if my Estate should hold out ot afford it as I considered that I have already given him his portion of Estate should not increase before the division of the same takes place. Lastly I appoint My Loving Wife Lydia Shamburger Executrix and Horatio Sugg as Executor and also My Son Peter Shamburger as soon as he arrives at Lawful age to act to this My Last Will and Textament. In Testimony where of I have Set my hand Seal the day and year first above written. Peter Shamburger Signed, Sealed, Published and Declared by me Peter Shamburger to be my last Testament and Will in presence of A McKinnon, James Dunlop Peter Shamburger's headstone shows a death date of 1837, but the will was not written until 18 Jan 1838. In the divorce papers for his daughter Mary, it is stated that her father died after Jan 1838. Moore County Court - May 1838. The last will and Testament of Peter Shamburger, deceased, was admitted to probate by the oths of Angus McKinnon and James Dunlop, the Subcribing witness, and ordered to be recorded. It is recorded in Book B, in records at full length. Lydia Shamburger, one of the Executors named in the will, came into Court and was qualified Executrix to Said Will. Horatio Sugg, the other Executor, was neither qualified ir renounced his right. Horatio Suggs came to court and was qualified Executor (later). (Horatio Sugg is Lydia's nephew, son of Zilpha Wright and Harbarton H. Suggs.) Feb Term 1839. Moore County NC Inventory Book D, pp. 86-88. Estate of Peter Shamburger, deceased.
