Baines Deed Nash County, N. C. This Indenture made this the second day of January in the year of our Lord one Thousand Eight hundred and forty-five by and between Lazarus Cook of the County of Nash and State of North Carolina of the one part and A. B. Baines of the other part, Witnesseth, that the said Lazarus Cook for and in consideration of the some (sic) of one hundred and seventy five dollars to me in hand paid by the said A. B. Baines, have bargained, sold and conveyed and by these presents doth bargain, sell and convey unto the said Baines a certain tract or parcel of Land lying and being in the county aforesaid and on the south side of Tar River on the waters of toisnott swamp and bounded as follows, viz, beginning at a pine in Marmaduke Ricks line then down the Polley bridg branch to the said swamp to a white oake then East to a pine near the Rowly front then nearly north to a pine then west to a Red oake then north to a stake on the Road then up said Road to a pine then north to a pine in Rick's Line then west along said Rick's line to the first station containing two hundred and twenty five acres, be the same more or less to have and to hold the said Land and premises together with all the appurtenances thereunto belonging to him the said A. B. Baines his heirs and assigns forever and I the said Lazarus Cook do for myself, my heirs, executors and assigns forever warrant and defend the Right and title of said land to be free and clear from the lawful claim or claims of Any other person or persons whatsoever in testimony whereof, I the said Lazarus Cook have set my hand and seal the day and date first above written. (Signed) Lazarus Cook (Seal) In the presents of us (Signed) Jesse Battle (Signed) Gideon Strickland Nash County - In the Probate Court Aug. 9, 1869 The execution of the above deed from Lazarus Cook to A. B. Baines was this day duly proven before the undersigned Justice of Probate for said County by N. Ferris, the subscribing witnesses being dead, who testified that he was well acquainted with the hand writing of Jesse Battle, one of the subscribing witnesses and was satisfied that the name of said Battle was in his own handwriting. Therefore let the said Deed with this certificate be registered. (Signed) J. P. Jenkins Probate Judge Registered August 10th 1869 in obedience to the above order (Signed) William T. State Archives Microfilm Nash County Deeds Book 19 //Contributor's notes: Twenty-four years elapsed from the date this deed was executed until it was registered at the courthouse. By 1869, when it was finally registered, the grantor and both witnesses were dead.
