This Indenture *maid this the 12th day of September and in the year of our Lord *won thousand Seven hundred Ninety seven by & between Soloman Carter of the County of Nash and State of North Carolina of the won part & Jacob Cook of the same County and State aforsd. of the other part, Witnesseth that for and in Consideration of the sum of won hundred & twenty pound Virginia Money to me in Hand paid by the said Cook & the Receipt *hearof I doth Acknowledge my self fully Satisfied contented and paid I have Given Granted *Bargaind & sold & by these presents do freely fully and absolutely Give Grant bargain sell *alean and set over unto the sd. Jacob Cook his *eirs and *asigns forever two hundred Acres of Land *ling & being in the County of Nash on the North side of *Tarriver bounded as follows Beginning on Sd. River bank at a white oake on Jeremiah Stephenses line thence along sd. Stephenses line North nine East 108 pole to a pine thence North 44 Wst 300 pole to a post oak thence along a line of marked trees to a white oake on the River bank thence Down the Course of the River to the Beginning unto him the sd. Jacob Cook his Eirs and asigns forever to have and to hold the aforsd. Land and premises with all the *wrights privileges and *appertainces thereunto belonging *warinting the same to be free from the Lawfull *Clame or Demands of any other person or persons Whatsoever that shall pretend to Lay any clame title or interest thereunto or any part or parcel thereof In Witness thereof I have *hearunto set my hand and seal this Day and date above Written. Term 1799 The within Deed in open court duly proved by the oath of John Stevens & ordered to be Registered Test Wm. Hall CC And is Registered By W. S. Mearns Regr. Source: N. C State Archives microfilm of the Deeds of Nash County, 1799, Book 6, page 432 //Contributor's notes: Words marked with an asterisk exhibit the characteristics of what we now call phonetic spelling. Most words so spelled need no explanation. Two which might are the terms alean and appertainces. The intended terms were "alien" and "appurtenances". Jacob Cook actually lived in Franklin County. He died soon after this deed was executed. This deed was not recorded until 1799 when Jacob's estate was being settled. The land involved in this deed was sold to Thomas Babb by a deed dated Oct. 15, 1799 (recorded in book 6, page 434) for the benefit of the widow and orphans of Jacob Cook.
