NASH COUNTY, NC - DEEDS - William & Milly Woodley to Thos. H. Battle, 1912 --------------¤¤¤¤¤¤-------------- This deed made the 6th day of July 1912, by William Woodley and Milly Woodley, his wife parties of the first part, to Thos. H. Battle party of the second part: Witnesseth, that whereas, said parties of the first part are justly indebted to The Bank of Rocky Mount for money borrowed, in the sum of One Hundred and Seventy-five Dollars, as evidenced by a sealed note of even date herewith, due and payable on the 6th day of July 19,1913 with interest from maturity at the rate of six percent per annum, payable quarterly, and are honestly desirous of securing the prompt payment of the same: Now, therefore, in consideration of premises and of the sum of five dollars paid to the parties of the first part by the party of the second part, the receipt of which is hereby acknowledged, the said parties of the first part have bargained and sold, and by these presents do bargain and sell and grant and convey to the party of the second part, his heirs and assigns, a certain lot of land lying in Edgecombe County, and in the City of Rocky Mount and State aforesaid, and described as follows: Being the home place of the parties of the first part fronting 60 feet on the east side of Atlantic Avenue and running back 150 feet and being lot No. 25 of Block of the John H. Logan Survey and being the lot conveyed to William Woodley be deed from Gus B. Chapman recorded in Book 160 Page 200 of Edgecombe Registry and it is agreed that the parties of the first part shall keep the premises insured for the benefit of said debt, in default of which the party of the second part may insure and add the premium to the debt hereby secured. To have and to hold said land, with all its privileges and appurtenances, unto the party of the second part, his heirs and assigns forever. And the parties of the firs part expressly state, and covenant that they are seized in fee simple of said land, that the same is free from any encumbrance whatever, and that they will forever warrant the title to the same against the claims of all persons whatsoever. The condition of this deed is, that if said note shall be paid in full with all interest promptly on the day it matures, then this deed shall be null and void. But if said note shall not e paid in full, with all interest, promptly on its day of maturity, then the said party of the second part, at the request of any other holder of said note, shall advertise said land for thirty days at the court-house door in Tarboro and three other public places in the county, and sell the same at Post Office Door in Rocky Mount at public auction for cash (at which sale any holder of said note shall have full power to bid), and out of the proceeds pay whatever may be due on said note and all expenses of selling including a reasonable charge for his services, and the surplus, if any pay to the said parties of the first part.
