This file was contributed for use in the USGenWeb Archives by: Helen Sharpe Turn1104@aol.com ==================================================================== In the name of god amen I Nathan Joiner of the County of Nash and State of North Carolina being in a low state of health but of perfect mind and memory calling to mind the mortality of the body and knowing that it is appointed for all men to die do this fourth day of August in the year of our Lord one thousand Eight Hundred and thirty six make publish and declare this my last will and testament in manner and form following to wit first I lend to my beloved wife Annis Joiner all my land where I now live all my stock of every kind and all the rest of my Estate and after her death - Item I give my land to my Daughter Juda Joiner and all my stock of every kind and all the rest of my Estate if my Daughter Juda should die with out an heir lawfully begotten of her body then the land to return back to my son David Joiner, and all the rest of my Estate to be Equally divided between my two sons Thomas & David Joiner. Item I give to my two Sons five dollars each to be paid in money by my exetor I do hereby appoint my Brother Matthew Joiner Exetor to this my last will & testament in witness I have hereunto set my hand and affixed my seal the day and date above written Nathan (his Mark ) Joiner Acknowledge signed & sealed in the presance of Polly (her mark) Joiner and David M. Deans State of North Carolina Nash County Court of Pleas and Quarters Session November Term 1840 It appearing to the satisfaction of the court that the foregoing paper writing purporting to be the last will and testament of Nathan Joiner had been duly proven by the subscribing witnesses at November Term 1836 while Arthur Whitfield was Clerk and not by him recorded it is ordered that the court that the same be recorded by the present clerk.
