This file was contributed for use in the USGenWeb Archives by: Hunter Ferrell hferrell@couriernet.infi.net ==================================================================== Will of Everett Lamb I Everett Lamb of Nash County North Carolina being of Sound mind & memory, but considering the uncertainty of my Earthly existence, do make & declare this my last will & testament in manner and form following, that is to say: Item the first – I will & desire that my Executor herein after named, shall provide for my body a decent burial, suitable to the wishes of my relations and friends, & pay all funeral expenses, together with my Just debts, howsoever & to whomsoever owing, out of the money that may first come into his hands, as a part or parcel of my estate. Item 2nd, I give & devise to my beloved wife Nanney Lamb, my home tract of Land, including all of my lands that I have not heretofore deeded off with my mansion house, all out houses & other improvements; to have & to hold to her the said Nannie Lamb for & during the time of her natural life or widowhood, in satisfaction for, & in lieu of her dower & thirds of, & in all my real estate. Item 3rd, I give & devise to my beloved wife nannie Lamb one hundred dollars to be paid to her out of my estate by my Executor, at the expiration of twelve months after my death. Item 4th I give & devise to my beloved wife Nanney Lamb, one bed bedstead & furniture (her choice) Item 5th I give & devise to my beloved wife Nanney Lamb, provisions for her & her family that may be living with her at my death, for twelve months after my death, to be allotted to her by three freeholders chosen by herself for that purpose. Item 6th I give & devise to my beloved wife Nanney Lamb, one bowfat (her choice.) Item 7th I give unto my beloved wife Nanney Lamb the right to dispose of the property given & divided to her in Items the third, fourth, fifth & sixth as she may desire after my death. Item the 8th, I give & bequeath to my beloved Grand Daughter Mary Whitley, one bed, bedstead & necessary clothing as her absolute property forever. Item 9th, I give & devise to my beloved Sons (Jackson Lamb & Thomas Lamb,) all the tract of land on which I now live, including all of my lands that I have not heretifore deeded off, to be equally divided between them after the death or widowhood of my beloved wife (Nanney Lamb,) to have & to hold to them & their heirs in fee simple forever. Item 10th, I give & devise to my beloved Daughter (Eliza wife of Jonas Perry,) all the property heretifore lent to her, as her absolute property forever. Item 11th, I give & devise to my beloved Daughter (Sythoney wife of Lindsey Perry,) all the property heretifore lent to her, as her absolute property forever. Item 12th I give & devise to my beloved Daughter (Ally wife of Perry Whitley,) all the property heretifore lent to her, as her absolute property forever. Item 13th I give & devise to my beloved Daughter, (Penelope Lamb,) all the property heretifore lent to her, as her absolute property forever. Item 14th I will & desire that my Executor, sell the remaining property that may be on hand at my death, if any, & collect all that is justly due to my estate, pay all just & lawful expenses for settling my estate after my death, & divide the surplus, if any, equally between my two sons (Jackson Lamb & Thomas Lamb) & Lastly – I do hereby constitute & appoint my trusty friend, (Elijah H Morgan,) my lawful Executor, to all intents & purposes to execute this my last will & testament, according to the true intent & meaning of the Same; & every part & clause thereof, hereby revoking & declaring utterly void all other wills & testaments by me heretifore made In witness whereof I the Said Everett Lamb, do hereunto Set my hand & Seal, this the 29th day of April AD 1858. Bridgers his Jacob Daniel Everett X Lamb (Seal) mark Whereas I Everett Lamb of the county of Nash and state of North Carolina have made my last will and testament in writing bearing date the 29th day of April in the year of our Lord one thousand Eight hundred & fifty eight in & by which I give and bequeath’d to my Granddaughter Mary Whitley one bed bedstead and necessary clothing, and to my two sons Jackson & Thomas Lamb the remaining part of my property or the money which it might of sold for according to the true intent of my foregoing or last will dated as bove the 29th day of April one thousand eight hundred & fifty eight Now therefore I do by this my writing which I hereby declare to be a codicil to my said last will and testament and to be taken as a part thereof, order & declare that my will is that the bed bedstead & necessary clothing which I give my Grand Daughter Mary Whitley be sold as a part of my estate after my death & the money distributed according to the 14th item of my will dated 29th of April 1858 and that my beloved wife Nanny Lamb in addition to what I gave her in my will dated the 29th of April 1858 have all the mony that may be on hand at my death to dispose as she desires and lastly it is my desire that this codicil be annexed to and made a part of my last will and testament as aforesaid to all intents and purposes in witness whereof I have hereinafter subscribed my name and affixed my seal this the 13th day of February AD 1862 his Everett Lamb (seal) Mark The above codicil dated the 13th day of February 1862 was subscribed by the said Everett Lamb in our presence and the will dated the 29th day of April 1858 acknowledged by him to each of us to be his last will and desire and we at the testator’s Request and in his presence have signed our names as witnesses hereunto.
