B. Baines Administrator of Ruthey Morgan and of Nancy Morgan Vs Ezekiel Morgan, Wright Morgan, Moses Morgan, Jackson Morgan, Reuben Murray & wife Toppen, Gray Morgan, Joseph Bryant & wife Cherry, Ana Smith, James Morgan, Irvin Finch & Susan, Archibald H. Denton, & wife Harriet, Alsey M. Cone, Henry R. Cone, James Cone John Cone, Blount Perry, & wife Nancy, Susan Cone, & Wm. Cone & the children of Celia Ferrall. To the Justices of Nash County Court. Humbly complaining shows unto your worship your petition in aforesaid, that in the year 1853, his intestate, Ruthey Morgan, died in said county and that administrator on her estate was committed to your petitioner at Febry Term of said year, that your petitioner took into his pocession the personal estate of his said intestate and sold the same and paid the debt and has in hand several hundred dollars of money for distribution among the next of kin, (several__lines struck out_) ____________________________________________________________________________. That the said Ruthey left as her next of kin, the defendant Ezekiel Morgan, her grand-son, who is the child of William Morgan, & is entitled to one ninth of said estate, he furthered shows that a said Ezekiel resides, beyond the limits of the said state and that the defendant, Wright Morgan, Moses Morgan, Jackson Morgan, Toppen wife of Reuben Murray, Gray Morgan, & Winifred R. Morgan who are her grand children and are the children of John Morgan, and are entitled to one ninth of said estate. Your petitioner shows that they all reside in this County, except the defendant, & Gray Morgan, who is a non resident, and the defendant. Cherry, wife of Joseph Bryant & a daughter of the intestate who resides in Nash County, and are entitled to one ninth of said estate, and the defendant, Archibald H. Denton & wife Harriet, Asley M. Cone, Henry R. Cone, James Cone, John cone, Blount Perry, & wife Nancy, Susan Cone & William Cone who are the great grand children of his intestate, being the children of Wm. Cone, who was the son of Elizabeth Cone, a daughter of his intestate, that said defendants reside in the County and are entitled to one ninth of said estate, and the defendant Ana Smith, of this county who is a daughter of his intestate and is entitled to one ninth of said estate, and the defendant James Morgan and Susan, wife of Irvin Finch, a son and daughter of his intestate who reside in this county and are each entitled to one ninth of said estate & that the said Wm Morgan, John Morgan, Martha Cone & Elizabeth Cone, & her son William aforesaid, died before the said Ruthey, & that your petitioners is decision of paying owe the said estate to the parties on of depositing the same in the office of the Clerk of this Court, and to that end he prays that your worships will order an account to be stated of the sum in his hands, and discerns that the same money be paid to the parties entitled or onto the office aforesaid, & that your worship, will make such other and further orders & decrees as may be maybe _____ to effectuale that end, yours petitioners pray that advertisement may be made for the said non residents & that copies of this petition & _____ may infers for the other defendant commanding them to appear at the next Term of the Court, then & there to answer this petition,. & And your petition will ever pray. Notice on Thursday the 2 day of June next I shall offer for sale at Southampton one likely Negro man on a ___it of Six Months, as the property of Nancy Morgan died, for distribution. Baines Administrator of Nancy Morgan Vs Ezekiel Morgan, Wright Morgan, Moses Morgan, Jackson Morgan,& Wininford R. Morgan, Joseph Bryant & wife Cherry , Ana Smith, James Morgan & Irvin Finch & wife Susan & the children of Celia Ferrell. To the Justices of Nash of Nash County Court. Humbly complaining, showeth unto your Worship your petitioner A.B. Baines that in the latter part of the year 1852 Nancy Morgan died instate in this county & that administrator on her estate was committed by this court to your petitioner at Febry Term 1853. That your petitioner took into his position the personal estate of his intestate and sold the same & with the proceeds paid the debts of his instate and now have a small sum in his hands for distribution among the next of kin. That Celia Ferrell a sister of the intestate died before your intestate leaving behind children entitled to one seventh of said estate & that your petitioner has paid one to them. (Next Paragraph stricken out) That William Morgan a brother of said intestate, died before his intestate leaving a son, the defendant Ezekiel Morgan, who is entitled to one seventh of said estate, your petitioner shows that the defendant Ezekiel resides beyond the limits of this state. That John Morgan a Brother of his intestate died before the said Nancy, leaving the following children, viz, the defendants, Wright Morgan, Moses Morgan, Jackson Morgan, Toppen wife of Reuben Murray, & Gray Morgan, & Winifred Morgan, who are entitled to one seventh of said estate and all reside in this county except Gray Morgan who resides beyond the limits of the state. That she had a sister by the name of Martha Cone who died before him said intestate, leaving a child the defendant, Cherry , wife of Joseph Bryant, of this County, who is entitled to one seventh of said estate, That she also had a sister named Elizabeth Cone who died many years since leaving an only child named Wm. Cone who died before your intestate, leaving children, but your petition, of said estate is advised that they are not entitled to any portion of said estate or money collected, those more distantly related than brother & sisters, children are not admitted as distributies. She also left a sister the defendant Ana Smith of this county, who is entitled to one seventh of said estate, and a brother the defendant, James Morgan of this county, and a sister the defendant, Susan wife of Irvin Finch, also of this county, who are each entitled to one seventh of said estate. That your petitioner in desion,(?) of paying over said estate to the parties entitled or into this office of the Clerk of the Court and to that end we pray that your worship will order an account to her stated of the account is in his hand & when the same is executained(?) deems it to be paid to the defendants according to their rights or into the office as aforesaid, and that your worship will make such other offer thru orders & decrees, as may be we pray. Of Ruthy Morgan Vs Ezekiel Morgan & others This cause coming on to be heard on the part of the Clerk & exhibits filed, and it appearing from said report that after deducting all cost, this is the sum of two hundred sixty four 06/100 dollars’ ($264.06) in the hands of the petitioner or administrator of said Ruthy Morgan and there being no objection to said report, it is in all accept confined, and it of hearing that the petitioner has fully settled with the children of Celia Ferrell, who were entitled to one ninth to wit, $29.34, it is deemed that he retain said amount for his own use. It is further deemed that he retain one ninth $29.34 as administrator of Nancy Morgan, and that he pay one ninth $29.34 to the defendants Wright Morgan, Moses Morgan, Jackson Morgan, Rubin Murray in the right of his wife Toppin, Gray Morgan, and Winnifred R. Morgan, to be equally divided between them, one ninth to Joseph Bryant in the right of his wife Cherry to wit. $29.34, one ninth to wit $29.34 to Archibald H. Denton in the right of his wife Harriet, Asley M. cone, Henry R. Cone, James Cone, John Cone, Blount Perry in the right of his wife Nancy, Susan Cone and Millie Cone, to be divided equally between them, one ninth $29.34 To Anne Smith, one ninth $29.34 to James Morgan, and one ninth $29.34 to Irvin Finch in the right of his wife Susan. It is further decreed that the petitioners pay the amount respectively due the defendants to them or into the office of this court subject to the call of the parties. A. B. Baines Administrator of Nancy Morgan Vs. Ezekiel Morgan & others This case coming on to be heard on the report of this Clerk & the exhibit filed and it appearing from report that there is a balance of seven hundred & seventeen 16/100 dollars ($717.16) in the hands of the petitioner or administrator of the said Nancy Morgan after deducting all cost of this suit, and there being no objection to said report it is in all respect, confirmed, and it further appearing to the court that the children of Celia Ferrell were entitled as next of kin of said intestate to one seventh of said estate & that the petitioner has had a full settlement with them, it is decreed that they are not entitled to any thing now & that the petitioner retain for his own an one seventh of said balance ($101.03), It is further decreed that he pay to Ezekiel Morgan one seventh to wit $101.03, one seventh to wit $101.03 to Wright Morgan, Moses Morgan , Wininford R. Morgan, Jackson Morgan, Rubin Murray in the right of his wife Toppin and Gray Morgan, to be equally divided between them one seventh $101.03, to Joseph Bryant in the right of his wife Cherry, one seventh $101.03 to Anne Smith, one seventh $101.03 to Irvin Finch in right of his wife Susan. And it further appearing that the defendants, Ezekiel Morgan & Gray Morgan are not resident of the state, it is ordered, adjudged & decreed that the petitioner pay the sum decreed into the office of this court, subject to this call.
