This file was contributed for use in the USGenWeb Archives by: Pam Taylor family.historian@netzero.net ==================================================================== North Carolina Nash County I, Joseph Taylor, of the aforesaid county and State, being of sound mind, but considering the uncertainty of my earthly existence do make and declare this my last will and testament. 1st My executor, hereinafter named, shall give my body a decent burial suitable to the wishes of friends and relatives and pay all funeral expenses, together with all my just debts, out of the first moneys which may come into his hands belonging to my estate. 2nd I give and devise to my beloved wife Rena Taylor all the lands now in my possession. 3rd I give and devise to my son Levi Watson Taylor and his heirs in fee-simple a track of land in Ferrells Township, Nash County, adjoining the lands of A.T. Taylor. Beginning at a stake A.T. Taylors, thence East to a corner tree A.T. Taylors corner, thence North to the branch, thence up said branch to Pearl Taylors corner, thence near Switch to the head of a highland ditch, thence down said ditch to a stake A.T. Taylors line, containing about 40 acres more or less. 4th I give and devise to my son Pearl Taylor and his heirs in fee- simple a tract of land in Ferrell's Township, Nash County, adjoining the land of A.T. Taylor and others. Beginning at a stake A.T. Taylor's line Levi Watson Taylor corner, thence along A.T. Taylor's line West to a stake in F.S. Strickland line, thence along F.S. Strickland's line to a stake Dennis Simmons Lumber Co's corner, thence North to a stake J.E. Watson's corner, thence along J.E. Watson's line to a corner in the branch, thence down said branc to Levi Watson Taylor's corner, thence South along Levi Watson Taylor's line to stake in said highland ditch. A.T. Taylors line containing 40 acres more or less. 5th I give and bequeath to my daughter Mary Jane Taylor and her heirs in fee-simple a tract of land in Ferrell's Township, Nash County, adjoining the lands of A.T. Taylors, J.S. Haywood and others, beginning at a stout gum. J.S. Haywood's corner on the bank of Turkey Creek, thence along J.S. Haywood's line A.T. Taylors corner, thence South to a stake W.H. Haywood line thence West along W.H. Haywood line to the creek, thence up said creek to the beginning, containing 43 acres more or less. I also give the said Mary Jane Taylor a tract of land adjoining the lands of L.J. Massey, Eliza Lewis, beginning at a stake in James Morgan's line, thence South to a stake J.S. Haywood's line, thence down Turkey Creek to a stake in Eliza Lewis line thence up a branch to a stake in James Morgan's line thence along James Morgan's line to the beginning containing 10 acres more or less. 6th I give and bequeath to my daughter Martha Lena Taylor and her heirs in fee simple a tract of land in Ferrell's Township, Nash County, adjoining the lands of J.S. Haywood, F.S. Strickland and others beginning at a stake J.S. Haywood's line Mary Jane Taylors corner thence along J.S. Haywood line (East) to a corner line, thence a North line along Jos. S. Haywood line to the branch, thence along F.s. Strickland's line to a stake, F.S. Strickland's corner, thence West along F.S. Strickland's line to a stake. John Morgan's corner, thence along John Morgan's line to a stake to Mary Jane Taylor corner, containing 48 acres more or less. After the death of my wife, Reney Taylor, my bequest is that all property be sold and equally divided among my heirs. 7th I hereby constitute and appoint my friend J.L. Bryant my lawful executor to all interests and purposes to execute this my last will and testament according to the trim (?) intent and meaning of the same and every part and clause thereof, hereby revoking and declaring utterly void all other wills and testaments by me heretofore made. In witness whereof, I, the said Joseph Taylor do hereunto set my hand and seal! This 14 day of Dec 1903. his Joseph Taylor mark Signed, sealed, published and declared by the said Joseph Taylor to be his last will and testament in the presence of us who at his request and in his presence do subscribe our names as witnesses thereto. Chamblee State of North Carolina In the Superior Nash County Court A paper p?parting ? the last will and testament of Joseph Taylor, deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for the said County by O.W. Williams and the due execution thereof by the said Joseph Taylor by the oath and examination of A.T. Taylor and J.P. Chambly two of the subscribing witness thereto; who being duly sworn, doth dispose and say, and each for himself despoith and saith that he is a subscribing witness to the paper writing now shown him, purportive to be the last will and testament of Joseph Taylor that the said Joseph Taylor in the presence of this deponent subscribed his name at the end of said paper-writing, which is now shown as aforesaid, and which bears date of the 14th day of Dec. 1903. And the deponent further saith that the said Joseph Taylor the testator aforesaid, led at the time of subscribing his name as aforesaid declare the said paper writing so subscribed by him and exhibited to be his last will and testament and this deponent did thereupon subscribe his name at the end of said will, as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith, that at the same time when the said testator subscribed his name to the said last will is aforesaid and at the time of the deponent's subscribing his name as an attesting witness thereto, as afroesaid, the said Joseph Taylor was of sound mind and memory, of full age to execute a will, and was not under any restraint, to the knowledge, information or belief of this deponent. Sills Clerk Superior Court North Carolina In the Superior Court Nash County It is therefore considered and adjudged by the Court that the said paper-writing and every part thereof is the last will and testament of Joseph Taylor deceased.
