Witness: A B Toomer CC We the subscribers being called upon by Thomas Robeson, Thomas Callender and Joshua Potts in behalf of the Heirs of the late Thomas Cunningham to lay off and divide the following Negroes into six shares as the Estate of Thomas Cunningham deceased To Thomas Robeson for three shares A Negro man named Quash valued at $400 A Negro woman named Rachel and child John at $300 A girl named Fanny at $170 A boy named James at $100 Subject to a payment of ten dollars to be paid to the next mentioned share To Thomas Callender for one share A Mulatto girl named Kitty valued at $300 To received as above stated $10 To be paid by the next mentioned shares $36 2/3 To Polly [Mary] and Jane Kirkwood one share each A Mulatto girl named Crissey valued at $270 " " " " Peggy at $250 " " " " Sally at $210 Deduct the thirty six dollars and two thirds to be paid as above Six shares at $346 2/3 each share comes to the amount of the whole valuation New Hanover County Wilmington 16th Decm'r 1803 Wit: Robt W Brown ---------- North Carolina New Hanover County Wilmington NC To whom it may concern we whose names are hereunto subscribed being Heirs at law to the estate of the late Thomas Cunningham to wit Thomas Robeson for his own sixth, the same for Jonathan Robeson by power of attorney for his one sixth, the same for John Kirkwood by purchase and sale for one sixth amounting to three sixths in claim to said Estate, Thomas Callender by marriage with Elizabeth Robeson by heirship for one sixth, Mary Kirkwood her one sixth and Jane Kirkwood her one sixth by heirship, do hereby severally agree to manner terms and proportion of the within division of the said nine Negroes and we do all further acknowledge that each and every of us have individually received in possession from Joshua Potts Executor by and through the within the valuation and division made by Peter Maxwell, Thomas N Pasteur and Christopher Dudley the identical shares as so allotted to us and the said Thomas Callender on his part hereby acknowledges that he has received of Thomas Robeson ten dollars and of Mary and Jane Kirkwood their thirty six and two thirds dollars in fulfillment of his share of said Negroes; And we do all and every of us forever release each other in the premises as touching the Negroes and Mullattoes of said estate being each content with our respective shares in possession; And further we do severally agree that the Old Negro Virgil and Fanny his wife shall remain excluded from our undivided individual claim or possession and that we will each in proportion to our respective shares of said estate support and maintain those two old Negroes as long as they live they being no longer able to labour In Witness of this our agreement and division of Negroes &c we hereunto severally do subscribe our hands and set out respective seals at Wilmington in New Hanover County the sixteenth day of December 1803 being the day on which the said Negroes were divided Thomas Robeson Thomas Robeson purchased of John Kirkwood Thomas Robeson purchase of Jonathan Robeson Thomas Callender Mary Kirkwood Anna Jane Kirkwood Wit: Robt W Brown File at: http://files.usgwarchives.net/nc/newhanover/court/cunningh3430wl.txt This file has been created by a form at http://www.poppet.org/ncfiles/ File size: 3.9 Kb
