AA, p. 260-262 26 Feb 1844 Owen FENNELL, Sheriff to Jacob JAMES, Sr., Heirs of Samuel JAMES-lands of Spicer PAGETT. This Indenture made on the 26th day of February 1844 between Owen FENNELL, Sheriff of the county of New Hanover, State of North Carolina on the one part and Jacob JAMES, Sr. of the County & State aforesaid on the other part; Witnesseth that whereas by virtue of five Justices Judgements whereon Jacob JAMES, Sr., Heirs of Sam’l JAMES & John SHEPHERD were plaintiffs and Spicer PADGETT, Atherton HENDERSON & Amos ROCHELLE were defendants, executions opened and were levied on the lands of the said Spicer PADGETT hereinafter described and the proceedings retrieved to the Court of Pleas & Quarter Sessions of the said County of New Hanover, whereupon the said court at June Term 1843 opened a rendition exponas? or order of sale commanding the said Sheriff to expose to public sale the lands & tenements aforesaid and Jacob JAMES, Sr. is pltf. & Spicer PAGETT defendants also are other out for the sum of one hundred dollars wherein Jacob JAMES, Sr is plaintiff & Spicer PAGETT defendant, also the sum of twenty seven dollars & 39/100 wherein Jacob JAMES, Sr. is plaintiff & Spicer PAGETT & E. HENDERSON and defendants, also the sum of fifteen dollars and 27/100 wherein the heirs of Sam’l JAMES and plaintiffs & Spicer PAGETT defendant and the sum of forty nine dollars & 48/100 wherein John SHEPHERD is plaintiff & Spicer PAGETT & Amos ROCHELLE are defendants together with all costs to which the sd. PAGETT, HENDERSON & ROCHELLE are liable are on record many appear and whereas the said Sheriff by virtue of his Office and the units of bench—? expenses aforesaid did proceed on the 11th day of September 1843 at the Court House in the town of Wilmington to sell the lands & tenements for ready money after having duly advertised the same according to law, where upon Jacob JAMES, Sr. became the purchaser at the sum of seventy five dollars, now therefore this Indenture witnesseth that I, Owen FENNELL, Sheriff as aforesaid for and in conditions of the said sum of seventy five dollars to me in hand paid by the said Jacob JAMES, Sr. the receipt where of is hereby fully acknowledged hath bargained, sold, conveyed and confirmed and if these presents doth bargain, sell convey and confirm unto him the said Jacob JAMES, Sr. his heirs and assigns forever all the rights title, claims, interest or demand of the said Spicer PAGETTE, in the lands aforesaid, lying and being in the said County of New Hanover and bounded as follows beginning on a Cypress on the bank of Holly Shelter Creek onto the mouth of a small branch running on north course to James STUBBONS corner, thence an east course to a post oak on the bank of the creek, thence down the creek to the beginning supposed to contain one hundred & fifty acres be the same more or less, also a piece or parcel of land knowns abut he name of the Hogg Land which land was bough from General M. HOGG by Lott WILLIAMS & sold by him to Robert L. SHARPLESS lying on the north side of Holly Shelter Creek, joining the land of BRADLEYS on one side and the first mentioned piece on the other side, containing three hundred and fifty acres more or less, which lands will more fully appear by reference to a deed from R. L. SHARPLESS to Spicer & Nelson PAGETT, registered in the Records of New Hanover County Book H, page 407? To have & to hold to him the said Jacob JAMES, Sr his heirs and assigns in as full and ample a manner as I the said Owen FENNELL, Sheriff as empowered to do by virtue of my offer to convey and aspire the same and no further.
