Isaac HINES to Joshua JAMES, both of New Hanover Co., NC
20 Aug. 1836

This Indenture made the 20th day of August 1836 between Isaac HINES of the 
County aforesaid of the first part & Joshua JAMES of the Second part. Witnesseth 
that the said Isaac HINES for & in Consideration of the Sum of three hundred 
Dollars paid by the Said Joshua JAMES to him the said Isaac HINES at & before 
the Sealing & delivery of these presents this Receipt where of is hereby 
acknowledged is hereby acknowledged hath granted bargained sold released & 
confirmed unto them the Said Joshua JAMES his heirs & assigns all that tract or 
parcel of lands situated in the County of New Hanover aforesaid about Fourteen 
miles from Wilmington beginning at a Small Island at a Cypress at the Mouth of 
Island Creek running thence down the river towards Marl Bluff - S. W. 74 degrees 
90 poles to a pine on the river then S E 16 degrees 320 poles to a pine thense 
N. E 74 degrees 180 poles to a pine on the Creek thence down the Creek to the 
first Station containing 360 acres more or less to have & to hold the said tract 
or parcel of land to the said Joshua JAMES & his heirs to the only use benefit & 
behoof of the said Joshua JAMES his heirs & assigns —- — for which purpose I the 
Said Isaac HINES for myself my heirs Exect’rs, Adminr’s & assigns do Warrant & 
hereby forever defend the said land & premises & every part or parcel hereto 
belonging including all buildings & improvements unto him the said Joshua JAMES 
& his heirs against the Lawful claim or claims of all persons provided never the 
less that the said Isaac HINES his Exect’rs. or Admtr’s shall cause & truly pay 
or cause to be paid truly & fully satisfied Four certain notes give by said 
HINES on the — day of January Last & payable on first day of January next to the 
following persons by 2 notes or Bonds payable to Sam’l FRINK? one for one 
hundred & twelve Dollars & the other for one hundred & thirteen dollars one note 
to Jesse WESTBROOK for Seventy Dollars & one note payable to William ASHE for 
Forty Dollars  on Each of which said notes the said Joshua JAMES is Security now 
it is understood that the Said Isaac shall well & truly pay & fully discharge 
the said notes so that Said Joshua JAMES shall in no manner Suffer or figured 
but eh defaults & improve or default to pay the Same but be fully & clearly 
discharged them the above Indenture to be void otherwise to remain in full force 
& virtue.

of the Subscribing Witnesses.
